AN ACT
SB 5513
Relating to
the financial administration of the State Department of Fish and Wildlife;
appropriating money; limiting expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. There are appropriated
to the State Department of Fish and Wildlife, for the biennium beginning July
1, 2011, out of the General Fund, the following amounts, of which the
department may expend up to 54 percent during the period beginning July 1,
2011, and ending June 30, 2012, for the following purposes:
(1) Fish
Division $ 5,175,443
(2) Wildlife
Division $ 793,838
(3) Administrative
Services
Division $ 640,890
(4) Debt
service $ 338,094
(5) Capital
improvement $ 142,194
SECTION 2. Notwithstanding any
other law limiting expenditures, the following amounts are established for the
biennium beginning July 1, 2011, as the maximum limits for payment of expenses
from fees, moneys or other revenues, including Miscellaneous Receipts and
including federal funds from the Pacific Coastal Salmon Recovery Fund, but
excluding lottery funds and federal funds not described in this section,
collected or received by the State Department of Fish and Wildlife, for the
following purposes:
(1) Fish

(3) Administrative
Services
Division $ 39,082,952
(4) Capital
improvement $ 7,711,722
(5) Department
of State Police
enforcement contract $ 21,275,954
SECTION 3. Notwithstanding any other
law limiting expenditures, the following amounts are established for the
biennium beginning July 1, 2011, as the maximum limit for payment of expenses
from lottery moneys allocated from the Parks and Natural Resources Fund to the
State Department of Fish and Wildlife, for activities and projects to implement
section 4 (8), Article XV of the Oregon Constitution, of which the department
may expend up to 54 percent during the period beginning July 1, 2011, and
ending June 30, 2012, for the following purposes:
(1) Fish

(2) Wildlife
Division $ 1,293,181
SECTION 4. Notwithstanding any
other law limiting expenditures, the following amounts are established for the
biennium beginning July 1, 2011, as the maximum limits for payment of expenses
from federal funds other than those described in section 2 of this 2011 Act
collected or received by the State Department of Fish and Wildlife, for the
following purposes:
(1) Fish

(2) Wildlife
Division $ 20,939,782
(3) Administrative
Services
Division $ 2,107,896
SECTION 5. (1) Notwithstanding any
other law limiting expenditures, the limitation on expenditures established by
section 2 (2)(c), chapter 668, Oregon Laws 2009, for the biennium beginning
July 1, 2009, as the maximum limit for payment of expenses from fees, moneys or
other revenues, including Miscellaneous Receipts and including federal funds
for contract services, but excluding lottery funds and federal funds not
described in section 2, chapter 668, Oregon Laws 2009, collected or received by
the State Department of Fish and Wildlife for wildlife diversity, is increased
by $100,000.
(2) Notwithstanding any other law
limiting expenditures, the limitation on expenditures established by section 4
(1)(a), chapter 668, Oregon Laws 2009, for the biennium beginning July 1, 2009,
as the maximum limit for payment of expenses from federal funds other than
those described in section 2, chapter 668, Oregon Laws 2009, collected or
received by the State Department of Fish and Wildlife for fish propagation, is
increased by $1,350,000.
(3) Notwithstanding any other law
limiting expenditures, the limitation on expenditures established by section 4
(2)(b), chapter 668, Oregon Laws 2009, for the biennium beginning July 1, 2009,
as the maximum limit for payment of expenses from federal funds other than
those described in section 2, chapter 668, Oregon Laws 2009, collected or
received by the State Department of Fish and Wildlife for wildlife habitat, is
increased by $400,000.
SECTION 6. This 2011 Act being
necessary for the immediate preservation of the public peace, health and
safety, an emergency is declared to exist, and this 2011 Act takes effect on
its passage.
