AN ACT
HB 5011
Relating to
the financial administration of the Department of Community Colleges and
Workforce Development; appropriating money; limiting expenditures; and
declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. (1) There are
appropriated to the Department of Community Colleges and Workforce Development,
for the biennium beginning July 1, 2011, out of the General Fund, the following
amounts, of which the department may expend up to 54 percent during the period
beginning July 1, 2011, and ending June 30, 2012, for the following purposes:
(a) Operations $ 2,848,208
(b) Skill
centers $ 550,000
(c) Debt
service on the outstanding
general obligation bonds sold
pursuant to Article XI-G
of the Oregon Constitution $ 15,704,592
(2) There is appropriated to the
Department of Community Colleges and Workforce Development, for the biennium
beginning July 1, 2011, out of the General Fund, the amount of $395,760,700 for
the Community College Support Fund for distribution to community college
districts and community college service districts. The department may expend up
to 65 percent of the amount appropriated under this subsection during the
period beginning July 1, 2011, and ending June 30, 2012.
SECTION 2. Notwithstanding any
other law limiting expenditures, the following amounts are established for the
biennium beginning July 1, 2011, as the maximum limits for payment of expenses
from fees, moneys or other revenues, including Miscellaneous Receipts, but
excluding lottery funds, federal funds and those funds described in section 7
of this 2011 Act, collected or received by the Department of Community Colleges
and Workforce Development, for the following purposes:
(1) Department
of Community
Colleges and Workforce
Development $ 4,387,388
(2) Oregon
Youth Conservation
Corps $ 2,461,970
SECTION 3. Notwithstanding any
other law limiting expenditures, the amount of $115,924,416 is established for
the biennium beginning July 1, 2011, as the maximum limit for payment of
expenses from federal funds other than those described in section 4 or 5 of
this 2011 Act collected or received by the Department of Community Colleges and
Workforce Development.
SECTION 4. Notwithstanding any
other law limiting expenditures, the amount of $1,403,590 is established for
the biennium beginning July 1, 2011, as the maximum limit for payment of
expenses for the Oregon Youth Conservation Corps from federal funds other than
those described in section 5 of this 2011 Act collected or received by the
Department of Community Colleges and Workforce Development.
SECTION 5. For the biennium
beginning July 1, 2011, expenditures by the Department of Community Colleges
and Workforce Development for payments to individuals, organizations or units
of government from federal National Emergency Grant funds are not limited.
SECTION 6. For the biennium
beginning July 1, 2011, expenditures by the Department of Community Colleges
and Workforce Development for the federal funds debt service on Build America
Bonds are not limited.
SECTION 7. Notwithstanding any
other law limiting expenditures, the amount of $25,308 is established for the
biennium beginning July 1, 2011, as the maximum limit for payment of expenses
by the Department of Community Colleges and Workforce Development from moneys
received from the Western Oregon Timber Severance Tax Fund and the Eastern
Oregon Timber Severance Tax Fund for the Community College Support Fund.
SECTION 8. Notwithstanding any
other law limiting expenditures, the amount of $7,469,632 is established for
the biennium beginning July 1, 2011, as the maximum limit for payment of
expenses by the Department of Community Colleges and Workforce Development from
lottery moneys allocated from the Administrative Services Economic Development
Fund to the department for debt service on lottery bonds.
SECTION 9. This 2011 Act being
necessary for the immediate preservation of the public peace, health and
safety, an emergency is declared to exist, and this 2011 Act takes effect July
1, 2011.
