AN ACT

HB 5056

Relating to state financial administration; appropriating money; and declaring an emergency.

Be It Enacted by the People of the State of Oregon:

SECTION 1. (1) There is appropriated to the Judicial Department, for the biennium beginning July 1, 2011, out of the General Fund, the amount of $7,400,000 for the purpose of providing conciliation and mediation services in circuit courts.

(2) The Chief Justice of the Supreme Court shall distribute the moneys appropriated under this section to the counties of this state to fund conciliation and mediation services in circuit courts. The Chief Justice shall consult with the presiding judges of the circuit courts before making the distributions.

SECTION 2. (1) There is appropriated to the Judicial Department, for the biennium beginning July 1, 2011, out of the General Fund, the amount of $7,400,000 for the purpose of operating law libraries or providing law library services.

(2) The Chief Justice of the Supreme Court shall distribute the moneys appropriated under this section to the counties of this state based on revenues received from filing fees collected during the 2009-2011 biennium in civil actions commenced in the circuit court for the county.

SECTION 3. There is appropriated to the Judicial Department, for the biennium beginning July 1, 2011, out of the General Fund, the amount of $140,000 for the purpose of administering the appellate mediation program established under ORS 2.560, including payment of administrative costs and costs of providing mediation services to indigent parties.

SECTION 4. There is appropriated to the Department of Human Services, for the biennium beginning July 1, 2011, out of the General Fund, the amount of $30,000 for the purpose of funding the administration of ORS 417.805, 417.810 and 417.815 by the Office of Children’s Advocate.

SECTION 5. There is appropriated to the Housing and Community Services Department, for the biennium beginning July 1, 2011, out of the General Fund, the amount of $470,000 for the purpose of providing housing for individuals and families with low incomes.

SECTION 6. There is appropriated to the Oregon University System, for the biennium beginning July 1, 2011, out of the General Fund, the amount of $330,000 for the purpose of funding clinical legal education programs at accredited institutions of higher education that provide civil legal services to victims of domestic violence, stalking or sexual assault.

SECTION 7. There is appropriated to the State Department of Agriculture, for the biennium beginning July 1, 2011, out of the General Fund, the amount of $150,000 for the purpose of funding individual farm credit mediations.

SECTION 8. This 2011 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2011 Act takes effect July 1, 2011.
