SUMMARY
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
Allocates, over 10-year period, $20 million in each fiscal year
to Department of Transportation for study, research and
development of innovative and technologically advanced systems
for moving people and goods within Oregon.
Requires that such systems maintain or improve current air
quality in state and reduce single-occupant motor vehicle
operation by five percent from level existing at beginning of
10-year period.
A BILL FOR AN ACT
Relating to allocation of lottery revenues for improvement of
transportation; and appropriating money.
Be It Enacted by the People of the State of Oregon:
**************************** SECTION 1. { + (1) In each fiscal
year during the period beginning July 1, 1997, and ending on June
30, 2007, there is allocated from the Executive Department
Economic Development Fund created by ORS 461.540, the amount of
$20 million. All amounts allocated under this section shall be
transferred to the Transportation Improvement Fund established by
section 2 of this Act.
(2) The annual amounts required to be transferred to the
Transportation Improvement Fund under subsection (1) of this
section, together with all interest earnings on the amounts on
deposit from time to time in the Transportation Improvement Fund,
are continuously appropriated only for the purposes of:
(a) Study, research and development of innovative and
technologically advanced systems, processes and procedures for
the movement of people and goods within Oregon while maintaining
or improving air quality in the urban areas in this state.
(b) Study, research and development of innovative and
technologically advanced systems, processes and procedures that
will reduce the incidence of single-occupant motor vehicle travel
in this state, as determined on or about July 1, 1997, by five
percent, as determined on or about June 30, 2007.
(3) Except as provided in subsection (4) of this section, and
notwithstanding any other provision of law, the annual allocation
made by this section shall be satisfied and credited as and when
net proceeds from the operation of the state lottery are received
and before any other allocation, appropriation or disbursement of
the net proceeds from the operation of the state lottery is made
in the applicable fiscal year.
(4) For purposes of this section, net proceeds from the
operation of the state lottery in each fiscal year include all
revenues derived from the operation of the state lottery in each
fiscal year less:
(a) The revenues used in that fiscal year for the payment of
prizes and the expenses of the state lottery as provided in
section 4 (4)(d), Article XV of the Oregon Constitution, ORS
461.500 (2) and 461.510 (3) and (4);
(b) The payment of lottery bonds as provided in section 4
(4)(d), Article XV of the Oregon Constitution; and
(c) The revenues required to be applied, distributed or
allocated as provided in ORS 391.130 and 461.543. + }
**************************** SECTION 2. { + The Transportation
Improvement Fund, separate and distinct from the General Fund, is
established in the State Treasury. All moneys in the fund are
appropriated continuously to the Department of Transportation for
the purposes specified in section 1 (2) of this Act. Interest
received on moneys credited to the Transportation Improvement
Fund shall accrue to and become part of the Transportation
Improvement Fund. + }
