                             SUMMARY

The following summary is not prepared by the sponsors of the

brief statement of the essential features of the measure as
introduced.

  Authorizes State Fish and Wildlife Commission to issue permits
for protection of juvenile salmonids from cormorants on certain
coastal rivers.
  Appropriates $50,000 from General Fund for protection
activities.
  Declares emergency, effective on passage.

                        A BILL FOR AN ACT
Relating to the protection of juvenile salmonids from cormorants;
  creating new provisions; repealing ORS 498.246 and sections 41
  and 41b, chapter 3, Oregon Laws 1995 (special session);
  appropriating money; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Sections 41 and 41b, chapter 3, Oregon Laws
1995 (special session) are repealed. + }
  SECTION 2.  { + ORS 498.246 is repealed and section 3 of this
Act is enacted in lieu thereof and added to and made a part of
ORS chapter 498. + }
  SECTION 3.  { + (1) The State Fish and Wildlife Commission
shall issue not more than three permits annually for activities
involving the protection of juvenile salmonids from cormorants
(Phalacrocoracidae) on Oregon coastal river systems between Cape
Falcon and Cascade Head.
  (2) Activities authorized under the permits shall not include
the killing, trapping or other taking of cormorants.
  (3) Persons to whom permits are issued may subcontract with
others for the performance of protection activities. + }
  SECTION 4.  { + In addition to and not in lieu of any other
appropriations or moneys made available by law or from other
sources, there is appropriated to the State Department of Fish
and Wildlife, for the biennium beginning July 1, 1995, out of the
General Fund, the amount of $50,000. Such sum may only be
expended in an amount not to exceed $25,000 per year, to pay
permit holders for protection activities described in section 3
of this Act. + }
  SECTION 5. { +  This Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this Act takes effect upon its
passage. + }
