SUMMARY
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
Establishes expenditure limitation for Department of
Corrections for administrative and financing costs of community
corrections capital construction projects. Creates Housing of
Inmates from Other Jurisdictions Account. Continuously
appropriates money in account to the department for costs of
incarceration.
Declares emergency, effective on passage.
A BILL FOR AN ACT
Relating to corrections; appropriating money; limiting
expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Notwithstanding any other law, the amount of
$2,554,615 is established for the biennium beginning July 1,
1995, as the maximum limit for payment of expenses from fees,
moneys or other revenues, including Miscellaneous Receipts,
including Anti-Drug Abuse Act funds, excluding federal funds,
collected or received by the Department of Corrections for costs
of financing and administering the capital construction approved
under ORS 423.525. + }
SECTION 2. { + The Housing of Inmates from Other Jurisdictions
Account is created within the General Fund. Moneys credited to
the account are continuously appropriated to the Department of
Corrections for costs of incarceration. The Department of
Corrections shall deposit all moneys received by the Department
as reimbursement under section 1 (3), chapter ___, Oregon Laws
1996 (Enrolled ___ Bill ___) (LC 249), into the account. + }
SECTION 3. { + Notwithstanding any other law, the amount of
$7,782,808 is established for the biennium beginning July 1,
1995, as the maximum limit for payment of expenses from the
Housing of Inmates from Other Jurisdictions Account created in
section 2 of this Act. + }
SECTION 4. { + This Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this Act takes effect on its
passage. + }
