SUMMARY
The following summary is not prepared by the sponsors of the

consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
Appropriates money from General Fund to Emergency Board to
replace underrealized lottery revenues.
Increases appropriation from General Fund to Department of
Education for fiscal year beginning July 1, 1996. Decreases
appropriation from General Fund to Department of Education for
fiscal year beginning July 1, 1995.
Decreases appropriation from General Fund to Community College
System Support Fund for biennium beginning July 1, 1995.
Appropriates money from General Fund to Emergency Board to
provide for costs resulting from community college district
formation.
Modifies method of calculation of General Fund revenue
estimate.
Declares emergency, effective on passage.
A BILL FOR AN ACT
Relating to state financial administration; appropriating money;
and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + In addition to and not in lieu of any other
appropriation, there is appropriated to the Emergency Board, out
of the General Fund, for the biennium beginning July 1, 1995, the
amount of $25 million. Such sum may be allocated by the Emergency
Board only to replace underrealized lottery revenues
unconditionally allocated by the Sixty-eighth Legislative
Assembly. + }
SECTION 2. { + (1) In addition to and not in lieu of any other
appropriation, there is appropriated to the Emergency Board, out
of the General Fund, for the biennium beginning July 1, 1995, the
amount of $30 million. Such sum may be allocated by the Emergency
Board only to replace underrealized lottery revenues that were
unconditionally allocated by the Sixty-eighth Legislative
Assembly.
(2) The Emergency Board shall allocate from the appropriation
made in subsection (1) of this section only such amount as the
Oregon Department of Administrative Services determines that the
quarterly estimate of available 1995-1997 lottery resources has
declined from the estimate made in December 1995.
(3) Any unallocated portion of the amount appropriated by
subsection (1) of this section shall be repaid to the General
Fund on the date any quarterly revenue forecast required by ORS
291.342 (2) estimates that the General Fund ending balance for
the biennium ending June 30, 1997, is less than $42 million. + }
SECTION 3. { + The Emergency Board shall consider revised
projections of local revenues for any allocation made by the
Emergency Board of moneys appropriated in section 1 or 2 of this
Act for the purpose of replacing the Executive Department
Economic Development Fund allocation made by section 10 (3),
chapter 814, Oregon Laws 1995. + }
SECTION 4. { + (1) Notwithstanding any other law, the
appropriation made to the Department of Education, out of the
General Fund, for the fiscal year beginning July 1, 1996, by
section 2, chapter 432, Oregon Laws 1995, for the State School
Fund, is increased by $15,600,000.
(2) Notwithstanding any other law, the appropriation made to
the Department of Education, out of the General Fund, for the
fiscal year beginning July 1, 1995, by section 1, chapter 432,
Oregon Laws 1995, for the State School Fund, is reduced by
$15,600,000. + }
SECTION 5. { + Notwithstanding any other law, the
appropriation made to the Community College System Support Fund,
out of the General Fund, for the biennium beginning July 1, 1995,
by section 4, chapter 415, Oregon Laws 1995, is reduced by
$1,850,000. + }
SECTION 6. { + In addition to and not in lieu of any other
appropriation, there is appropriated to the Emergency Board, out
of the General Fund, for the biennium beginning July 1, 1995, the
amount of $1,745,500. Such sum may be allocated by the Emergency
Board only to provide for costs resulting from community college
district formation. Such costs shall include the effect of
community college district formation on local school
revenues. + }
SECTION 7. { + For the purpose of section 7b, chapter 649,
Oregon Laws 1995, any amount allocated by the Emergency Board for
the purpose of replacing the Executive Department Economic
Development Fund allocation made by section 10 (3), chapter 814,
Oregon Laws 1995, shall not be included in the computation of the
statewide average combined State School Fund allocation and local
revenue per extended ADMw. + }
SECTION 8. { + (1) Notwithstanding ORS 291.349 (1), any amount
appropriated from the General Fund, for the biennium beginning
July 1, 1995, after adjournment sine die of the regular session
of the Sixty-eighth Legislative Assembly, shall be added to the
General Fund revenue amounts estimated to be received for the
biennium, as estimated after adjournment sine die of the regular
session.
(2) The amount added to the estimate of General Fund revenues
under subsection (1) of this section shall be prorated between
the estimate of General Fund revenues received from corporate
income and excise taxes and the estimate of General Fund revenues
received from all other sources proportionately based on the
amount of revenue increase projected from each source in the
December 1995 revenue estimate. + }
SECTION 9. { + This Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this Act takes effect on its
passage. + }
