AN ACT
Relating to lottery funds; limiting expenditures; and declaring
an emergency.
Be It Enacted by the People of the State of Oregon:

EFFECTS OF ALLOCATIONS + }
SECTION 1. { + Effective July 1, 1997, and thereafter during
the 1997-1999 biennium, all lottery revenues available to benefit
the public purposes specified in section 4, Article XV, Oregon
Constitution, that are in excess of distributions or allocations
required by law shall be maintained in the Administrative
Services Economic Development Fund. + }
SECTION 2. { + All moneys in the Administrative Services
Economic Development Fund as of July 1, 1997, and thereafter
shall be reserved to meet the commitments of this Act. + }
SECTION 3. { + The allocation of the Administrative Services
Economic Development Fund made by this Act shall supersede,
replace and be in lieu of any allocation of such funds in prior
years. + }

SECTION 4. { + There is allocated, from the Administrative
Services Economic Development Fund to the Economic Development

Education, for the State School Fund, the amount of
$450,456,170. + }

SECTION 7. { + (1) The Legislative Assembly finds that the
emotional and behavioral problems related to gambling may impose
additional costs on state government and on the state economy,
such as additional mental health expenditures, increased law
enforcement costs and lost economic output. The use of a portion
of the net receipts from video lottery games to pay the costs of
preventing and treating emotional and behavioral problems related
to gambling promotes the creation of jobs and this state's
economic development by offsetting and treating the negative
economic consequences of such behavior.
(2) There is allocated, from the Administrative Services
Economic Development Fund, to the Oregon Department of
Administrative Services, for distribution to counties for
treatment of gambling addiction, the amount of $4,000,000. + }

SECTION 8. { + There is allocated, from the Administrative
Services Economic Development Fund, to the Oregon State Fair, for
the support of Oregon State Fair activities and operations, the
amount of $250,000. + }
SECTION 9. { + There is allocated, from the Administrative
Services Economic Development Fund, to the Department of Higher
Education, to be expended for biotechnology for cereal wheat
research and breeding activities at the Agricultural Experiment
Station at Oregon State University, the amount of $750,000. + }
SECTION 10. { + There is allocated, from the Administrative
Services Economic Development Fund, to the Department of
Environmental Quality, the following amounts for the following
purposes: + }

SECTION 11. { + There is allocated, from the Administrative
Services Economic Development Fund, to the State Parks and
Recreation Department, to be deposited in the Lottery Bond Fund
established by chapter __, Oregon Laws 1997 (Enrolled House Bill
3041), for the revenues required to pay the state park lottery
bonds and any bonds issued to refund the state park lottery
bonds, to fund reserves for any of those bonds and to pay related
costs of the State Parks and Recreation Department, the amount of
$1,276,555. + }

SECTION 12. { + In addition to and notwithstanding any other
law, the amount of $17,600 is established as the maximum limit
for the payment of expenses from lottery moneys carried over from
the 1995-1997 biennium allocated from the Administrative Services
Economic Development Fund to the State Scholarship Commission, to
be used for the Community Service Voucher Program. + }
SECTION 13. { + In addition to and notwithstanding any other
law, the amount of $750,000 is established as the maximum limit
for the payment of expenses from lottery moneys allocated from
the Administrative Services Economic Development Fund to the

Department of Higher Education, for biotechnology for cereal

SECTION 14. { + In addition to and notwithstanding any other
law, the amount of $500,000 is established as the maximum limit
for the payment of expenses from lottery moneys allocated from
the Administrative Services Economic Development Fund to the
Department of Environmental Quality, to provide financial
assistance for upgrading or replacing fuel tanks containing
aircraft or marine fuel. + }
SECTION 15. { + In addition to and notwithstanding any other
law, the maximum limit for the payment of expenses from lottery
moneys allocated from the Administrative Services Economic
Development Fund to the Economic Development Department is
increased by the following amounts for the following
purposes: + }

SECTION 16. { + In addition to and notwithstanding any other
law, the amount of $250,000 is established as the maximum limit
for the payment of expenses from lottery moneys allocated from
the Administrative Services Economic Development Fund to the
Oregon State Fair, for operations and expenses. + }
SECTION 17. { + In addition to and notwithstanding any other
law, the maximum limit for the payment of expenses from lottery
moneys allocated from the Administrative Services Economic
Development Fund to the Department of Transportation is increased
by $160,000. + }

EDUCATION/STATE SCHOOL FUND ADJUSTMENTS + }
SECTION 18. { + (1) Notwithstanding any other law:
(a) The amount appropriated to the Department of Education by
section 1, chapter ___, Oregon Laws 1997 (Enrolled Senate Bill
Enrolled House Bill 5051 (HB 5051-A) Page 4
5519), out of the General Fund, for the fiscal year beginning
July 1, 1997, is reduced by $22,405,530.
(b) The amount appropriated to the Department of Education by
section 2, chapter ___, Oregon Laws 1997 (Enrolled Senate Bill
5519), out of the General Fund, for the fiscal year beginning
July 1, 1998, is reduced by $22,950,640.
(2) Notwithstanding any other law:
(a) The limitation on expenditures established by section 4,
chapter ___, Oregon Laws 1997 (Enrolled Senate Bill 5519), for
the fiscal year beginning July 1, 1997, as the maximum limit for
payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, including lottery funds,
excluding federal funds, collected or received by the Department
of Education for the State School Fund, is increased by
$27,405,530.
(b) The limitation on expenditures established by section 5,
chapter ___, Oregon Laws 1997 (Enrolled Senate Bill 5519), for
the fiscal year beginning July 1, 1998, as the maximum limit for
payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, including lottery funds,
excluding federal funds, collected or received by the Department
of Education for the State School Fund, is increased by
$17,950,640. + }

DISAPPROPRIATIONS + }
SECTION 19. { + On July 1, 1997, the 1995-1997 biennium
allocations from the Administrative Services Economic Development
Fund made by chapter 814, Oregon Laws 1995, to the Department of
Education for operations are reduced by $100,000 and such amount
is transferred to the Administrative Services Economic
Development Fund. + }

ADJUSTMENTS + }
SECTION 20. { + (1) The Oregon Department of Administrative
Services shall establish by rule a process for allocating
available moneys in the Administrative Services Economic
Development Fund on a quarterly basis to fulfill the biennial
allocations made in this Act. Except as provided in subsection
(2) of this section, all quarterly allocations shall be set at
one-eighth of the biennial allocations.
(2) If, in any quarter, the moneys transferred from the State
Lottery Fund to the Administrative Services Economic Development
Fund are insufficient to pay for the quarterly allocations
established under this Act, the Oregon Department of
Administrative Services shall:
(a) Satisfy the debt service obligations for the State Sewer
Bond Revolving Fund in the amount of $4,474,542 and the debt
service obligations for Orphan Sites in the amount of $2,103,229
prior to making any other allocations in this Act;
(b) Subject to paragraph (a) of this subsection, satisfy the
debt service obligations for Westside Light Rail in the amount of
$20,000,000 prior to making any other allocations in this Act;
(c) Subject to paragraphs (a) and (b) of this subsection,
satisfy the debt service obligations for the State Parks and
Recreation Department established by chapter __, Oregon Laws 1997
Enrolled House Bill 5051 (HB 5051-A) Page 5
(Enrolled House Bill 3041), in the amount of $1,276,555 prior to
making any other allocations in this Act; and
(d) Subject to paragraphs (a) to (c) of this subsection,
satisfy the debt service obligations for the Economic Development
Department established by chapter ___, Oregon Laws 1997 (Enrolled
House Bill 3041), from the allocation made to the Economic
Development Department by section 4 (2) of this Act prior to
making any other allocations in this Act.
(3) After the debt service obligations described in subsection
(2) of this section are satisfied, if the remaining moneys
transferred from the State Lottery Fund to the Administrative
Services Economic Development Fund are insufficient to pay for
the quarterly allocations established under this Act, these
allocations shall be reduced proportionately in sufficient
amounts to accommodate the revenue shortfall. + }
SECTION 21. { + Notwithstanding any other law, all sections of
this Act are subject to Oregon Department of Administrative
Services rules relating to allotting, controlling, and
encumbering funds. + }
SECTION 22. { + This Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this Act takes effect July 1, 1997. + }
