AN ACT
SB 61
Relating to arbitration;
creating new provisions; amending ORS 36.350; and prescribing an effective
date.
Be It Enacted by the People of the State of Oregon:
SECTION 1.
ORS 36.350 is amended to read:
36.350. (1) The
award of the arbitrators, together with the written agreement to submit, shall
be delivered to the clerk of the circuit court selected to render judgment on
the award. After charging and collecting a fee of $35 therefor, the clerk shall
enter the same of record in the office of the clerk. A copy of the award,
signed by the arbitrators, or a majority of them, shall also be served upon or
delivered to each of the parties interested in the award, and proof of such
service or delivery shall be filed with the clerk. If no exceptions are filed
against the same within 20 days after such service, judgment shall be entered
as upon the verdict of a jury, and execution may issue thereon, and the same
proceedings may be had upon the award with like effect as upon a verdict in a
civil action.
(2) If the award of the
arbitrators requires the payment of money, including but not limited to payment
of costs or attorney fees, the award must be accompanied by a separate
statement that contains the information required by ORCP 70 A(2)(a) for money
judgments.
SECTION 2. The amendments to ORS 36.350 by section 1
of this 1999 Act apply only to arbitration awards submitted to clerks of
circuit courts under ORS 36.350 on or after the effective date of this 1999
Act.
SECTION 3. This 1999 Act takes effect on January 1,
2000.
