AN ACT
SB 391
Relating to the Department
of Justice Client Trust Account; appropriating money; and declaring an
emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. (1) The Department of Justice Client Trust
Account is established in the State Treasury, separate and distinct from the
General Fund. All moneys in the account are appropriated continuously and shall
be used by the Department of Justice for payments to persons and agencies on whose
behalf civil enforcement actions are commenced.
(2) The trust account
established by this section shall consist of moneys recovered by the Department
of Justice in civil enforcement actions and temporarily credited to the account
prior to distribution of the moneys in accordance with law.
(3) Subaccounts may be
established within the Department of Justice Client Trust Account when the
department determines that subaccounts are necessary or desirable.
(4) Notwithstanding ORS
293.140, interest earned on moneys deposited in the trust account or in any of
its subaccounts shall be credited to the account or subaccount.
SECTION 2. This 1999 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 1999 Act takes effect July 1, 1999.
