Relating to ginseng regulatory activities; creating new provisions; amending ORS 576.810; repealing ORS 576.820; and appropriating money.

 

Be It Enacted by the People of the State of Oregon:

 

      SECTION 1. (1) The Ginseng Licensing Account is abolished. On the effective date of this 1999 Act, the unexpended balance of the Ginseng Licensing Account is appropriated and transferred to the Department of Agriculture Service Fund and is available for expenditure as provided under section 2 of this 1999 Act.

      (2) Abolishment of the Ginseng Licensing Account does not relieve any person of any fee or other obligation imposed under ORS 576.805 or 576.810 or any rule adopted pursuant thereto.

      SECTION 2. The State Treasurer shall deposit all moneys received by the State Department of Agriculture under ORS 576.805 and 576.810 into the Department of Agriculture Service Fund. The moneys are continuously appropriated to the department for the purpose of carrying out the provisions of ORS 576.805 and 576.810.

      SECTION 3. ORS 576.820 is repealed.

      SECTION 4. ORS 576.810 is amended to read:

      576.810. In accordance with any applicable provision of ORS 183.310 to 183.550, the State Department of Agriculture, by rule, shall establish a licensing system for persons who act as ginseng growers or dealers. [Such a] The system shall include, but not be limited to, provisions:

      (1) Prescribing the form and content of, and the times and procedures for submitting, an application for license issuance or renewal.

      (2) Prescribing the term of the license and the fee for original issuance and renewal of the license in an amount that does not exceed the cost of administering the licensing system.

      (3) Prescribing such certification requirements as may be necessary to promote or allow the sale of ginseng in interstate or international commerce.

      (4) Establishing an advisory [board] committee to provide assistance to the department in the administration of ORS 576.800 to 576.810.
