Relating to decedents' estates; creating new provisions; repealing ORS 112.017; and prescribing an effective date.

Be It Enacted by the People of the State of Oregon:

SECTION 1. ORS 112.017 is repealed.

SECTION 2. (1) The repeal of ORS 112.017 by section 1 of this 1999 Act applies to the estates of all decedents who die on or after the effective date of this 1999 Act.

(2) The repeal of ORS 112.017 by section 1 of this 1999 Act does not affect the application of ORS 112.017 to a decedent who died before the effective date of this 1999 Act if ORS 112.017 applied to the decedent's estate under the provisions of chapter 598, Oregon Laws 1993, or chapter 235, Oregon Laws 1995. The estate of a decedent who died before the effective date of this 1999 Act and that was subject to ORS 112.017 under the provisions of chapter 598, Oregon Laws 1993, or that was subject to ORS 112.017 as amended by chapter 235, Oregon Laws 1995, shall be administered as though ORS 112.017 had not been repealed.

SECTION 3. This 1999 Act takes effect on January 1, 2000.
