AN ACT

 

SB 5544

 

Relating to state financial administration; appropriating money; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

      SECTION 1. Sections 2 and 3 of this 1999 Act are added to and made a part of ORS 466.706 to 466.845.

      SECTION 2. (1) Pursuant to sections 2 to 8, chapter 767, Oregon Laws 1997, the Department of Environmental Quality may award additional essential services grants to any person who owns or is responsible for an underground storage tank holding an accumulation of motor fuel for resale and who meets the following criteria:

      (a) Except for the application deadlines set forth in sections 3 and 4, chapter 767, Oregon Laws 1997, the applicant meets the criteria set forth in section 3, chapter 767, Oregon Laws 1997;

      (b) The facility meets the criteria set forth in section 4, chapter 767, Oregon Laws 1997;

      (c) The department did not previously offer the applicant a grant;

      (d) The facility was in operation during the month of December 1998; and

      (e) The person who owns or is responsible for the facility submits an application to the department within two weeks after the effective date of this 1999 Act.

      (2) In the event grant applications are requested by more than one otherwise eligible facility from a single geographic area, neither facility shall receive a grant.

      SECTION 3. An essential services grant awarded pursuant to section 2 of this 1999 Act may be used only to pay for those expenses incurred by an applicant after the effective date of this 1999 Act.

      SECTION 4. In addition to and not in lieu of any other appropriation, for the biennium ending June 30, 1999, there is appropriated to the Department of Environmental Quality, out of the General Fund, the amount of $245,200 for the purpose of providing additional essential services grants under section 2 of this 1999 Act.

      SECTION 5. This 1999 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 1999 Act takes effect on its passage.
