Relating to Oregon Potato
Commission; creating new provisions; amending ORS 579.030; and repealing ORS
579.050.
Be It Enacted by the People of the State of Oregon:
SECTION 1.
ORS 579.030 is amended to read:
579.030. (1) There hereby is created the Oregon Potato
Commission. The commission shall consist of nine members to be appointed by the
Director of Agriculture for a term of [five]
four years, each to continue in
office until a successor is appointed and qualified. If a vacancy occurs, the director shall appoint a replacement member to
serve the unexpired term. In making appointments of members of the
commission the director shall take into consideration any nominations or
recommendations made to the director by growers or growers' organizations. The
appointments shall be made so that each major potato-producing area of the
state is represented as follows:
(a) Two from the area comprised of Malheur and Harney Counties.
(b) [Two] One from central Oregon, comprised of
the Counties of Crook, Deschutes, Gilliam, Sherman, Wasco, Wheeler and
Jefferson.
(c) Two from the area comprised of Klamath, Coos, Curry,
Douglas, Jackson, Josephine and Lake Counties.
(d) Two from the Blue Mountain area, comprised of the Counties
of Baker, Union, Wallowa, Grant, Morrow and Umatilla.
(e) One from the Willamette Valley area, comprised of the
Counties of Benton, Clackamas, Clatsop, Columbia, Hood River, Lincoln, Lane,
Linn, Marion, Multnomah, Polk, Tillamook, Yamhill and Washington.
(f) One as a member at
large.
(2) The director, or an official representative of the
director, and the Dean of the College of Agricultural Sciences of Oregon State
University, or an official representative of the dean, are ex officio members
of the commission, without right to vote. Subsection (1) of this section and
ORS 579.040 to 579.060 do not apply to ex officio members.
SECTION 2. The amendments to ORS 579.030 by section 1
of this 1999 Act, relating to the geographical representation of the Oregon
Potato Commission, apply to appointments made on or after the effective date of
this 1999 Act and do not terminate or shorten the term of any commission member
holding office immediately prior to the effective date of this 1999 Act.
SECTION 3. Notwithstanding any original term of
appointment, the term of office for any member of the Oregon Potato Commission
holding office on the effective date of this 1999 Act shall expire on the later
of the effective date of this 1999 Act or four years after commencement of the
term of office being served by the member on the effective date of this 1999
Act. Notwithstanding ORS 579.030, for each position on the commission, the
Director of Agriculture may reduce the term of office for the person first appointed
after the effective date of this 1999 Act for the purpose of preventing the
expiration of more than three terms of office in any one year.
SECTION 4. Notwithstanding any defect in the
membership of the Oregon Potato Commission, actions taken by the commission
prior to the effective date of this 1999 Act for the carrying out of commission
duties, functions and powers are validated.
SECTION 5. ORS 579.050 is repealed.
