Relating to citizen review
boards; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. (1) Subject to the availability of funds, a
local citizen review board shall review cases of youth offenders in the custody
of the Oregon Youth Authority and placed in substitute care. The local citizen
review board shall focus on public safety, youth offender accountability and
reformation in conducting the reviews.
(2) No later than July 1,
1999, the Judicial Department and the Oregon Youth Authority shall enter into
an intergovernmental agreement regarding the reviews conducted under subsection
(1) of this section. The intergovernmental agreement must outline the:
(a) Timing of the reviews;
(b) Participants to be
invited to the reviews; and
(c) Process to be followed
in conducting the reviews.
(3) The agreement must
specify that the reviews be conducted, at a minimum, at key transition points
in a case. Key transition points include, but are not limited to, the initial
placement of the youth offender and the point at which the youth offender is
preparing to leave substitute care.
(4) The local citizen review
board shall forward findings and recommendations generated at a review under
subsection (1) of this section to the court and any other parties designated in
the agreement under subsection (2) of this section. The court shall cause the
findings and recommendations to become part of the juvenile court file for
consideration by the juvenile court judge.
SECTION 2. Section 1 of this 1999 Act is repealed on
December 31, 2001.
SECTION 3. This 1999 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 1999 Act takes effect on its passage.
