AN ACT
HB 5011
Relating to the financial
administration of the Office of Community College Services; appropriating
money; limiting expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. There is appropriated to the Office of
Community College Services, for the biennium beginning July 1, 1999, out of the
General Fund, the amount of $2,115,260 for operations.
SECTION 2. There is appropriated to the Office of
Community College Services, for the biennium beginning July 1, 1999, out of the
General Fund, the sum of $408,009,332 for the Community College Support Fund
for distribution to community colleges and community college service districts
pursuant to ORS 341.626.
SECTION 3. In addition to and not in lieu of any other
appropriation, there is appropriated to the Office of Community College
Services, for the biennium beginning July 1, 1999, out of the General Fund, the
amount of $10,665,499 for the following programs:
(1) For the Community Colleges
Skill Centers Program
authorized pursuant to
ORS 329.945.................................................. $ 3,322,642
(2) For the Sabin Skills
Center of the North
Clackamas
School District................................................ $ 2,679,550
(3) For the Oregon Advanced
Technology Center
program
authorized pursuant to
ORS 329.930(3).............................................. $ 1,714,912

and state institutions
of
higher education under
the
State Board of Higher

SECTION 4. Notwithstanding any other law, the amount
of $7,747,744 is established for the biennium beginning July 1, 1999, as the
maximum limit for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, but excluding lottery funds and federal funds,
collected or received by the Office of Community College Services. The
limitation imposed by this section does not include fees, moneys or other
revenues collected or received by the Office of Community College Services for
the Oregon Youth Conservation Corps.
SECTION 4a. Notwithstanding any other law, the amount of $1,544,483 is established
for the biennium beginning July 1, 1999, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including Miscellaneous Receipts,
but excluding lottery funds and federal funds, collected or received by the
Office of Community College Services for the Oregon Youth Conservation Corps.
SECTION 4b. In addition to and not in lieu of any other appropriation, there is
appropriated to the Office of Community College Services, for the biennium
beginning July 1, 1999, out of the General Fund, the amount of $433,673 for the
Oregon Youth Conservation Corps.
SECTION 5. Notwithstanding any other law, the amount of $96,034,938 is established
for the biennium beginning July 1, 1999, as the maximum limit for payment of
expenses from federal funds collected or received by the Office of Community
College Services.
SECTION 6. In addition to and not in lieu of any other appropriation, there is
appropriated to the Office of Community College Services, for the biennium
beginning July 1, 1999, out of the General Fund, the amount of $4,733,427 which
may be expended only for debt service on the outstanding general obligation
bonds sold pursuant to Article XI-G of the Oregon Constitution.
SECTION 7. (1) In addition to and not in lieu of any other appropriation, there is
appropriated to the Emergency Board, out of the General Fund, for the biennium
beginning July 1, 1999, the sum of $3,014,005 for allocation to the Office of
Community College Services to support the 2000-2001 fiscal year operations of
regional partnerships between community colleges and state institutions of
higher education under the State Board of Higher Education.
(2) If any of the moneys described in
subsection (1) of this section are not allocated or obligated by the Emergency
Board prior to July 1, 2000, such unallocated and unobligated moneys on that
date become available for any other purpose for which the Emergency Board may
lawfully allocate funds.
SECTION 8. Of the amounts
appropriated under section 2 of this 1999 Act, $249,600,000 is considered to be
tax relief for purposes of ORS 291.355.
SECTION 9. Of the amounts distributed to the public school system from the
Community College Support Fund pursuant to ORS 341.626 for the fiscal year
beginning July 1, 1999, by section 2 of this 1999 Act, an amount equal to the
amount determined by the Department of Revenue to be the amount of reduction
pursuant to ORS 310.228, for community college districts and community college
service districts is specifically designated as replacement revenue within the
meaning of section 11 (9), Article XI of the Oregon Constitution. If any
additional amounts are distributed from the Community College Support Fund pursuant
to ORS 341.626 for the fiscal year beginning July 1, 1999, these amounts are
not replacement revenue within the meaning of section 11 (9), Article XI of the
Oregon Constitution.
SECTION 10. Of the amounts distributed to the public school system from the
Community College Support Fund pursuant to ORS 341.626 for the fiscal year
beginning July 1, 2000, by section 2 of this 1999 Act, an amount equal to the
amount determined by the Department of Revenue to be the amount of reduction
pursuant to ORS 310.228, for community college districts and community college
service districts is specifically designated as replacement revenue within the
meaning of section 11 (9), Article XI of the Oregon Constitution. If any
additional amounts are distributed from the Community College Support Fund
pursuant to ORS 341.626 for the fiscal year beginning July 1, 2000, these
amounts are not replacement revenue within the meaning of section 11 (9),
Article XI of the Oregon Constitution.
SECTION 11. Notwithstanding any other law, all sections of this 1999 Act are
subject to Oregon Department of Administrative Services rules related to
allotting, controlling, and encumbering funds.
SECTION 12. This 1999 Act being necessary for the immediate preservation of the
public peace, health and safety, an emergency is declared to exist, and this
1999 Act takes effect July 1, 1999.
