AN ACT
HB 5043
Relating to the financial
administration of the Department of State Police; appropriating money; limiting
expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. There is appropriated to the Department of
State Police, for the biennium beginning July 1, 1999, out of the General Fund,
the following amounts for the following purposes:
(1) State police activities
and operations................................................. $ 160,055,333
(2) Fish and wildlife
activities and
operations.................................. $ 5,426,634
SECTION 2. Notwithstanding any other law, there are
established for the biennium beginning July 1, 1999, as the maximum limits for
payment of expenses from fees, moneys or other revenues, including
Miscellaneous Receipts and federal funds for the Law Enforcement Data System
message switch reengineering, but excluding lottery funds collected or received
by the Department of State Police, the following amounts for the following
purposes:
(1) State police activities
and operations................................................. $ 41,562,857
(2) Fish and wildlife activities
and operations................................................. $ 14,469,536
(3) State Fire Marshal activities
and operations................................................. $ 12,925,061
SECTION 3. Notwithstanding any other law, there are
established for the biennium beginning July 1, 1999, as the maximum limits for
payment of expenses from federal funds collected or received by the Department
of State Police, the following amounts for the following purposes:
(1) State police activities
and operations................................................. $ 30,600,523
(2) Fish and wildlife
activities and
operations.................................. $ 349,764
SECTION 4. Section 2 of this 1999 Act does not limit
payments to cities, counties and districts for 9-1-1 emergency telephone
systems. Section 3 of this 1999 Act does not limit payments to cities and
counties for federal emergency management assistance.
SECTION 5. Notwithstanding any other law, the amount
of $2,559,704 is established for the biennium beginning July 1, 1999, as the
maximum limit for payment of fish and wildlife activities and operations
expenses from moneys or other revenues allocated to the Oregon Department of
Administrative Services Operating Fund from lottery funds made available under
section 4 (5), Article XV of the Oregon Constitution.
SECTION 6. In addition to and not in lieu of any other
appropriation, there is appropriated to the Emergency Board, out of the General
Fund, for the biennium beginning July 1, 1999, the sum of $515,373 for
allocation only to the Department of State Police for state police activities
and operations. Any moneys that remain unallocated and unobligated by the
Emergency Board on November 1, 2000, become available for any purpose for which
the Emergency Board may lawfully allocate funds.
SECTION 7. Notwithstanding any other law, all sections
of this 1999 Act are subject to Oregon Department of Administrative Services
rules related to allotting, controlling, and encumbering funds.
SECTION 8. This 1999 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 1999 Act takes effect July 1, 1999.
