AN ACT

Relating to the financial administration of the State Department of Geology and Mineral Industries; appropriating money; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

      SECTION 1. (1) There is appropriated to the State Department of Geology and Mineral Industries, for the biennium beginning July 1, 1999, out of the General Fund, the amount of $2,878,763 for operations.

      (2) Of the amount appropriated in subsection (1) of this section, up to $100,000 may be transferred to the Geology and Mineral Industries Account and used for necessary and reimbursed or reimbursable federal program expenditures.

      (3) Transfers made under subsection (2) of this section shall be retransferred to the General Fund no later than September 30, 1999, and shall be available for the purpose authorized in subsection (1) of this section.

      SECTION 2. Notwithstanding any other law, the amount of $2,472,420 is established for the biennium beginning July 1, 1999, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts and federal funds, but excluding lottery funds, collected or received by the State Department of Geology and Mineral Industries.

      SECTION 3. Section 2 of this 1999 Act does not affect, limit or apply to purchases of essential services to clean up lands following default of performance bonds or alternative securities for mined lands and deep oil, gas and geothermal wells, or to expenditures from the Geology and Mineral Industries Account resulting from deposits authorized under section 1 of this 1999 Act.

      SECTION 4. Notwithstanding any other law, the amount of $1,545,198 is established for the biennium beginning July 1, 1999, as the maximum limit for payment of expenses from federal funds, collected or received by the State Department of Geology and Mineral Industries.

      SECTION 5. (1) In addition to and not in lieu of any other appropriation, there are appropriated to the Emergency Board, for the biennium beginning July 1, 1999, out of the General Fund, the sum of $50,000 for allocation only to the State Department of Geology and Mineral Industries for professional services and the sum of $15,185 for allocation only to the State Department of Geology and Mineral Industries for publicity and publications. The Emergency Board may authorize expenditures of any or all of the amounts appropriated by this section upon submission of a plan by the State Department of Geology and Mineral Industries.

      (2) If all of the moneys referred to in subsection (1) of this section are not allocated by the Emergency Board prior to November 1, 2000, such moneys on that date become available for any other purpose for which the Emergency Board lawfully may allocate funds.

      SECTION 6. Notwithstanding any other law, all sections of this 1999 Act are subject to Oregon Department of Administrative Services rules related to allotting, controlling, and encumbering funds.

      SECTION 7. This 1999 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 1999 Act takes effect July 1, 1999.
