AN ACT

 

SB 834

 

Relating to aquaculture products; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

      SECTION 1. (1) The State Department of Fish and Wildlife shall create a pilot program to purchase aquaculture products from private aquaculture facilities. In implementing the program, the department shall spend at least 10 percent of the annual trout hatchery funds of the department on trout produced by private aquaculture facilities. Except as provided in subsection (3) of this section, the department shall contract with aquaculture facilities located within the State of Oregon.

      (2) The duration of a contract under subsection (1) of this section shall be for a minimum of one year and shall be determined by the contracting aquaculture facility. However, the contract may not extend beyond June 30, 2004.

      (3) The department may purchase aquaculture products from an out-of-state aquaculture facility if:

      (a) The private facilities within the State of Oregon are unable to provide the specified aquaculture products, and the department provides the facilities with reasonable notice of intent to purchase from an out-of-state aquaculture facility; or

      (b) The aquaculture products from facilities within the State of Oregon are infected or diseased.

      (4) As used in this section:

      (a) "Aquaculture" means agriculture devoted to the propagation, cultivation, maintenance, harvesting, processing, distribution and marketing of aquatic plants and animals in marine, brackish or fresh water that are for human consumption, bait or game purposes.

      (b) "Department" means the State Department of Fish and Wildlife as established in ORS 496.080.

      SECTION 2. The State Department of Fish and Wildlife shall report to the Seventy-first Legislative Assembly on the progress of the pilot program created in section 1 of this 1999 Act.

      SECTION 3. Sections 1 and 2 of this 1999 Act are repealed on June 30, 2004.

      SECTION 4. This 1999 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 1999 Act takes effect on its passage.
