AN ACT
SB 1098
Relating to allocation of
conserved water; amending sections 5, 6 and 7, chapter 726, Oregon Laws 1997;
and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1.
Section 5, chapter 726, Oregon Laws 1997, is amended to read:
Sec. 5.
Notwithstanding ORS 537.463, 537.465, 537.470 or 537.485, for the period
beginning on [the effective date of this
Act] October 4, 1997, and ending
July 1, [1999] 2003, sections 1, 2, 3 and 4,
chapter 726, Oregon Laws 1997, [of
this Act] shall apply in lieu of ORS 537.463, 537.465, 537.470 and 537.485,
respectively.
SECTION 2.
Section 6, chapter 726, Oregon Laws 1997, is amended to read:
Sec. 6. Sections 1
to 5, chapter 726, Oregon Laws 1997,
[of this Act] are repealed December
31, [1999] 2003.
SECTION 3.
Section 7, chapter 726, Oregon Laws 1997, is amended to read:
Sec. 7. The repeal
of sections 1 to 5, chapter 726, Oregon
Laws 1997, [of this Act] by
section 6, chapter 726, Oregon Laws
1997, [of this Act] shall not
affect the processing of any request for allocation of conserved water received
before July 1, [1999] 2003. After December 31, [1999] 2003, the Water Resources Department may complete processing of
any allocation of conserved water under sections 1 to 5, chapter 726, Oregon Laws 1997 [of this Act], provided that the request for allocation was received
before July 1, [1999] 2003.
SECTION 4. This 1999 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 1999 Act takes effect on its passage.
