AN ACT

 

SB 5541

 

Relating to the financial administration of the Department of Revenue; appropriating money; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

      SECTION 1. (1) There is appropriated to the Department of Revenue, for the biennium beginning July 1, 1999, out of the General Fund, the amount of $93,294,967 for the purpose of administrative expenses.

      (2) In addition to and not in lieu of any other appropriation, there is appropriated to the Emergency Board, for the biennium beginning July 1, 1999, out of the General Fund, the sum of $1,925,896, which may be allocated by the Emergency Board to the Department of Revenue for payment of expenses related to the department's implementation of new technology to improve the tax processing systems of the department.

      (3) If all of the $1,925,896 appropriated in subsection (2) of this section is not allocated by the Emergency Board before November 1, 2000, the unallocated moneys become available on November 1, 2000, for any other purpose for which the Emergency Board may lawfully allocate funds.

      SECTION 2. (1) In addition to and not in lieu of any other appropriation, there is appropriated to the Department of Revenue for the purpose of making payments authorized by ORS 307.244 and 310.630 to 310.690 the amount of $9,000,000 out of the General Fund, for the purpose of the Elderly Rental Assistance program for the biennium beginning July 1, 1999.

      (2) In addition to and not in lieu of any other appropriation, there is appropriated to the Emergency Board, for the biennium beginning July 1, 1999, out of the General Fund, the sum of $750,000, which may be allocated by the Emergency Board to the Department of Revenue for payment of expenses related to the Elderly Rental Assistance program.

      (3) If all of the $750,000 appropriated in subsection (2) of this section is not allocated by the Emergency Board before November 1, 2000, the unallocated moneys become available on November 1, 2000, for any other purpose for which the Emergency Board may lawfully allocate funds.

      SECTION 3. In addition to and not in lieu of any other appropriation, there is appropriated to the Department of Revenue the amount of $1 out of the General Fund for the purpose of Deferred Collection of Homestead Property Taxes (Senior Citizen Property Tax Deferral outlined in ORS 311.666 to 311.701) for the biennium beginning July 1, 1999.

      SECTION 4. There is transferred to the General Fund, for the biennium beginning July 1, 1999, the amount of $17,000,000 from the Senior Property Tax Deferral Revolving Account created under ORS 311.701.

      SECTION 5. After July 1, 1999, if the sum appropriated by section 3 of this 1999 Act plus the balance in the revolving account are not sufficient to make the payments required by ORS 311.701 (1), the State Treasurer shall advance, as an investment of the General Fund, such amounts as may be necessary to make such payments during the biennium beginning July 1, 1999. Any moneys so advanced shall be repaid in accordance with ORS 311.701 (5) with interest thereon computed with the rates described in ORS 311.674 (3) or 311.711 (4).

      SECTION 6. Notwithstanding any other law, the amount of $12,586,180 is established for the biennium beginning July 1, 1999, as the maximum limit for payment of expenses from fees, moneys or other revenues collected or received, excluding lottery funds and federal funds, including Miscellaneous Receipts, except those deposited in the Multistate Tax Commission Revolving Account and the Senior Property Tax Deferral Revolving Account by the Department of Revenue.

      SECTION 7. Section 6 of this 1999 Act does not limit expenditures for expenses of the Multistate Tax Commission.

      SECTION 8. Notwithstanding any other law, all sections of this 1999 Act are subject to Oregon Department of Administrative Services rules related to allotting, controlling, and encumbering funds.

      SECTION 9. This 1999 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 1999 Act takes effect July 1, 1999.
