AN ACT
HB 5012
Relating to the financial
administration of the Department of Consumer and Business Services; limiting
expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. Notwithstanding any other law, $170,978,323
is established for the biennium beginning July 1, 1999, as the maximum limit
for payment of administrative expenses from assessments, contributions, fees,
charges for service and other income, including Miscellaneous Receipts,
excluding lottery funds, but including federal funds for occupational safety
and health-related activities, manufactured home inspections, senior health
insurance benefit programs, and Office of Energy and Pacific Northwest Electric
Power and Conservation Planning Council activities, collected or received by
the Department of Consumer and Business Services.
SECTION 2. Section 1 of this 1999 Act does not limit,
affect or apply to expenditures from the:
(1) Workers' Benefit Fund.
(2) Self-Insured Employer
Adjustment Reserve.
(3) Self-Insured Employer
Group Adjustment Reserve.
(4) Federal Registry Fund
for payment to the Federal Financial Institutions Examination Council of annual
registry fees collected from state certified and licensed appraisers.
(5) Oregon Medical Insurance
Pool Account for payment of
claims and third party administration contracts.
(6) Consumer and Business
Services Fund for payment of contracted collection costs, including contracted
processing costs for the Combined Tax Reporting Program, contracted building
codes permit issuance costs, and workers' compensation paying agent reimbursements
as outlined in ORS 656.307.
(7) Special payments to the
Oregon Health Sciences University for research on occupational illness and
disease.
(8) Expenditures for loans
for small scale energy loan projects or for debt service.
(9) Expenditures made from
the Energy Efficient Construction Account.
SECTION 3. Notwithstanding any other law, the amount
of $5,388,424 is established for the biennium beginning July 1, 1999, as the
maximum limit for payment of expenses from federal funds collected or received
by Department of Consumer and Business Services for the Office of Energy.
SECTION 4. Notwithstanding any other law, all sections
of this 1999 Act are subject to Oregon Department of Administrative Services
rules related to allotting, controlling, and encumbering funds.
SECTION 5. This 1999 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 1999 Act takes effect on July 1, 1999.
