Relating to Pain Management
Demonstration Project.
Be It Enacted by the People of the State of Oregon:
SECTION 1. (1) There shall be established a Pain
Management Demonstration Project with the following purposes:
(a) To work with Oregon
Health Plan participants to manage and relieve the pain of any persons with
chronic pain enrolled in the plan;
(b) To improve or maintain
the functional status of Oregon Health Plan participants reporting chronic
pain;
(c) To decrease utilization
of health care and social service resources by Oregon Health Plan participants
reporting chronic pain; and
(d) To provide primary care
physicians and their staff with the skills and information necessary to manage
patients with chronic pain.
(2)(a) The Office of Medical
Assistance Programs shall administer the project, but no state resources may be
used in the administration of the project.
(b) The project shall
continue for no more than two years from the date of inception and shall
consist of six months of project preparation, one year of project
implementation and six months of data analysis and reporting.
(3) The project shall
consist of two demonstration sites, to be designated by the Office of Medical
Assistance Programs. In choosing demonstration sites, the office shall locate
one site in a rural area of the state and one site in an urban area of the
state.
(4) The Office of Medical
Assistance Programs is authorized to seek out and accept funds, grants and
other resources for the purposes of this section from all sources, public and
private.
(5)(a) Physicians shall be
selected for participation in the project to form a geographically
representative sample of patients reporting chronic pain for more than three months.
A physician shall not be required to participate and all physicians who
participate must receive and sign an informed consent agreement.
(b) Patients may be
nominated for participation in the project by a participating physician. All
patients who participate in the program must receive and sign an informed
consent agreement.
(6) Prior to January 1,
2002, the Office of Medical Assistance Programs shall report to the proper
legislative interim committee for medical and patient issues on the effectiveness
of the demonstration project in improving the care provided to persons with
chronic pain. The report shall address the desirability and feasibility of
expanding the project statewide.
