Relating to public safety;
amending ORS 181.667.
Be It Enacted by the People of the State of Oregon:
SECTION 1.
ORS 181.667 is amended to read:
181.667. (1)(a) The
certification of any police officer who does not serve as a police officer, or
any certified reserve officer who is not utilized as a certified reserve
officer, for any period of time in excess of three consecutive months[, unless the police officer or certified
reserve officer is on leave from a law enforcement unit,] is lapsed. Upon
reemployment as a police officer, or recommencing service as a reserve officer,
the person whose certification has lapsed may apply for certification in the
manner provided in ORS 181.610 to 181.690.
(b) Notwithstanding
paragraph (a) of this subsection, the certification of a police officer or
certified reserve officer does not lapse if the officer:
(A) Is on leave from a law
enforcement unit; or
(B) Is an honorably retired
police officer who meets the requirements established by the Department of
Public Safety Standards and Training under paragraph (c) of this subsection for
maintaining certification.
(c) The department, in
consultation with the Board on Public Safety Standards and Training, may adopt
rules establishing:
(A) A program of continuing
training for honorably retired police officers that would enable a police
officer whose certification would otherwise lapse under paragraph (a) of this
subsection to maintain certification for as long as the police officer meets
the training requirements; and
(B) A fee to be paid by
honorably retired police officers to maintain certification under this
subsection. The fee may not exceed the costs incurred by the department and
board in administering the training program.
(2) The certification of any fire service professional,
telecommunicator or emergency medical dispatcher who is not utilized as a fire
service professional, telecommunicator or emergency medical dispatcher for any
period of time in excess of 12 consecutive months, unless the fire service
professional, telecommunicator or emergency medical dispatcher is on leave from
a public or private safety agency, is lapsed. Upon reemployment as a fire
service professional, telecommunicator or emergency medical dispatcher, the
person whose certification has lapsed may apply for certification in the manner
provided in ORS 181.610 to 181.690.
