Relating to activities in
forest zones; and declaring an emergency.
Whereas the State of Oregon recognizes that youth camps serve
the important public interest of directly educating our youth about nature and
the prudent stewardship of the environment; now, therefore,
Be It Enacted by the People of the State of Oregon:
SECTION 1. Section 2 of this 1999 Act is added to and
made a part of ORS chapter 215.
SECTION 2. A
person may establish a youth camp on land zoned for forest use or mixed farm
and forest use, consistent with rules adopted by the Land Conservation and
Development Commission under section 3 of this 1999 Act.
SECTION 3. (1) Not later than one year after the
effective date of this 1999 Act, the Land Conservation and Development
Commission shall adopt rules establishing criteria for the approval of a youth
camp on lands zoned for forest use or mixed farm and forest use under section 2
of this 1999 Act. The rules shall incorporate protections for adjacent uses
substantially similar to those described in ORS 215.296. The rules also shall
allow the siting of a single caretaker dwelling in conjunction with a youth
camp, provided a dwelling does not exist on the subject property at the time of
application for the youth camp.
(2) For the period from the
effective date of this 1999 Act until the commission adopts final rules under
subsection (1) of this section, a county may not approve an application for
siting a youth camp on land zoned for forest use or mixed farm and forest use.
SECTION 4. This 1999 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 1999 Act takes effect on its passage.
