AN ACT

Relating to public contracts; creating new provisions; and amending ORS 279.312.

 

Be It Enacted by the People of the State of Oregon:

 

      SECTION 1. ORS 279.312 is amended to read:

      279.312. (1) Every public contract shall contain a condition that the contractor shall:

      [(1)] (a) Make payment promptly, as due, to all persons supplying to such contractor labor or material for the prosecution of the work provided for in such contract.

      [(2)] (b) Pay all contributions or amounts due the Industrial Accident Fund from such contractor or subcontractor incurred in the performance of the contract.

      [(3)] (c) Not permit any lien or claim to be filed or prosecuted against the state, county, school district, municipality, municipal corporation or subdivision thereof, on account of any labor or material furnished.

      [(4)] (d) Pay to the Department of Revenue all sums withheld from employees pursuant to ORS 316.167.

      (2) In addition to the conditions specified in subsection (1) of this section, every public improvement contract shall contain a condition that the contractor shall demonstrate that an employee drug testing program is in place.

      SECTION 2. The amendments to ORS 279.312 by section 1 of this 1999 Act apply to public improvement contracts entered into on or after the effective date of this 1999 Act.
