AN ACT

 

SB 5525

 

Relating to the financial administration of the Oregon Liquor Control Commission; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

      SECTION 1. Notwithstanding any other law, the following amounts are established for the biennium beginning July 1, 1999, as the maximum limits for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Oregon Liquor Control Commission for the following purposes:

 

      (1)     Administrative expenses......................... $         31,273,588

      (2)     Agents' compensation............................. $         38,541,532

      (3)     Capital improvement.............................. $              645,000

 

      SECTION 2. Section 1 of this 1999 Act does not limit expenditures for packaging and liquor purchases or debt service by the Oregon Liquor Control Commission.

      SECTION 3. Notwithstanding any other law limiting expenditures by the Oregon Liquor Control Commission for the payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Oregon Liquor Control Commission for the biennium beginning July 1, 1997, there is authorized to be expended, in addition to other limitations established by law, as modified by Emergency Board action, the sum of $427,040. Such sum may be expended only for agents' compensation.

      SECTION 4. Notwithstanding any other law, all sections of this 1999 Act are subject to Oregon Department of Administrative Services rules related to allotting, controlling, and encumbering funds.

      SECTION 5. This 1999 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 1999 Act takes effect on its passage.
