Relating to criteria for establishing farm dwelling in exclusive farm use zones.

Be It Enacted by the People of the State of Oregon:

SECTION 1. The Land Conservation and Development Commission shall evaluate the use of administrative rules that establish income criteria for dwellings customarily provided in conjunction with farm use under ORS 215.213 (1)(g) or 215.283 (1)(f) to determine whether the criteria prevent farmers from gaining approval of dwellings on their farms or authorize dwellings in conjunction with farm use for persons not engaged in farm use as defined in ORS 215.203 (2)(a). The commission shall study each case as it deems appropriate to make a determination. Prior to making a determination, the commission shall distribute the case studies and take public testimony on them. The commission shall report its findings to the Joint Legislative Committee on Land Use not later than December 31, 2000.
