AN ACT
HB 5015
Relating to the financial
administration of the Economic Development Department; appropriating money;
limiting expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. There is appropriated to the Economic
Development Department, for the biennium beginning July 1, 1999, out of the
General Fund, the sum of $2,973,449, for the following purposes and in the
following amounts:
(1) Oregon Arts Commission....................... $ 2,312,330
(2) Oregon Progress Board.......................... $ 661,119
SECTION 2. Notwithstanding any other law, the amount
of $60,844,418 is established for the biennium beginning July 1, 1999, as the
maximum limit for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Economic Development Department, for the
following purposes and in the following amounts:
(1) Administration of department
and community
development
programs.................................................. $ 7,291,583
(2) Oregon Community
Development Program............................ $ 52,777,151
(3) Other programs....................................... $ 775,684
SECTION 3. Notwithstanding any other law, the amount
of $79,939,530 is established for the biennium beginning July 1, 1999, as the
maximum limit for payment of expenses from lottery funds allocated from the
Administrative Services Economic Development Fund to the Economic Development
Department, for the following purposes and in the following amounts:
(1) Administration of department
and community
development
programs.................................................. $ 16,011,036
(2) Oregon Community
Development Program............................ $ 46,811,119
(3) Oregon Film and Video Office............... $ 948,788
(4) Pass-through............................................ $ 10,116,428
(5) Oregon Tourism Commission................ $ 6,052,159
SECTION 4. Notwithstanding any other law, the amount
of $53,257,238 is established for the biennium beginning July 1, 1999, as the
maximum limit for payment of expenses from federal funds collected or received
by the Economic Development Department, for the following purposes and in the
following amounts:
(1) Administration of department
and community
development
programs.................................................. $ 2,311,363
(2) Oregon Community
Development Program............................ $ 49,055,616
(3) Other programs....................................... $ 1,890,259
SECTION 5. Sections 2 and 3 of this 1999 Act do not
limit, affect or apply to expenditures for payments of loans to programs in the
Oregon Community Development Program and the composite Revenue Bond Program and
the Industrial Development Revenue Bond Program.
SECTION 6. Payment is authorized for the necessary
expenses of the Economic Development Department for travel, entertainment,
lodging, gifts and other expenses undertaken by the department and authorized
in writing by the Director of the Economic Development Department to promote
Oregon's economic development. The total amount of expenditures made under this
section and not otherwise authorized by law shall not exceed one-fourth of one
percent of the amount the department is authorized to expend for the biennium
beginning July 1, 1999.
SECTION 7. The Director of the Economic Development
Department may transfer among programs and administrative divisions within the
department an amount not to exceed five percent of the amount budgeted for
personal services, other services, supplies and capital outlay and funded by
lottery revenues for the biennium beginning July 1, 1999.
SECTION 8. Notwithstanding any other law, all sections
of this 1999 Act are subject to Oregon Department of Administrative Services
rules related to allotting, controlling and encumbering funds.
SECTION 9. This 1999 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 1999 Act takes effect July 1, 1999.
