AN ACT

Relating to ballot titles.
Be It Enacted by the People of the State of Oregon:
SECTION 1. (1) Notwithstanding ORS 250.035, the ballot
title for the amendment proposed by Senate Joint Resolution 39 (1999) shall be:

AMENDS CONSTITUTION: STATE MUST CONTINUE PAYING LOCAL GOVERNMENTS FOR
STATE-MANDATED PROGRAMS.
RESULT OF "YES" VOTE: "Yes" vote retains
requirement that state pay local governments for costs of state-mandated
programs.
RESULT OF "NO" VOTE: "No" vote repeals requirement
that state pay local governments for costs of state-mandated programs.
SUMMARY: This measure retains section 15, Article XI of the Oregon
Constitution, which requires state legislature to pay local governments for
costs of new state-mandated programs or increased level of services for
state-mandated programs. If costs are not paid, local governments need not
comply with law or rule requiring program or service. Contains exceptions.
Requires 3/5 vote of each house of state legislature to take certain actions
reducing state revenues that are distributed to local governments.

(2) ORS 250.085 does not
apply to the ballot title prepared under this section. The ballot title
prepared under this section is the ballot title to be printed in the voters'
pamphlet, as provided in ORS 251.185, and to be printed on or provided with the
ballot, as provided in ORS chapter 254.
