Relating to membership of
Land Conservation and Development Commission; creating new provisions; and
amending ORS 197.030.
Be It Enacted by the People of the State of Oregon:
SECTION 1.
ORS 197.030 is amended to read:
197.030. (1) There is established a Land Conservation and
Development Commission consisting of seven members appointed by the Governor,
subject to confirmation by the Senate pursuant to section 4, Article III,
Oregon Constitution.
[(2) In making
appointments under subsection (1) of this section, the Governor shall select
from residents of this state one member from each congressional district and
the remaining members from the state at large reflecting the geographic and
occupational makeup of the state. At least one and no more than two members
shall be from Multnomah County unless required to comply with requirement that
a member come from each congressional district.]
(2) The Governor shall
appoint to the commission:
(a) One member representing
Clatsop, Columbia, Coos, Curry, Lincoln and Tillamook Counties and those
portions of Douglas and Lane Counties lying west of the summit of the Coast
Range;
(b) Two members representing
Clackamas, Multnomah and Washington Counties;
(c) One member representing
Benton, Linn, Marion, Polk and Yamhill Counties and that portion of Lane County
lying east of the summit of the Coast Range;
(d) One member representing
Jackson and Josephine Counties and that portion of Douglas County lying east of
the summit of the Coast Range;
(e) One member representing
Baker, Crook, Deschutes, Gilliam, Grant, Harney, Hood River, Jefferson,
Klamath, Lake, Malheur, Morrow, Sherman, Umatilla, Union, Wallowa, Wasco and
Wheeler Counties; and
(f) One member representing
Benton, Clackamas, Linn, Marion, Multnomah, Polk, Washington and Yamhill
Counties and that portion of Lane County lying east of the summit of the Coast
Range.
(3) At least one member shall
be or have been an elected city official in Oregon and at least one member
shall be an elected county official at the time of appointment.
[(3)] (4) The term of office of each member
of the commission is four years, but a member may be removed by the Governor
for cause. Before the expiration of the term of a member, the Governor shall
appoint a successor. No person shall serve more than two full terms as a member
of the commission.
[(4)] (5) If there is a vacancy for any
cause, the Governor shall make an appointment to become immediately effective
for the unexpired term.
SECTION 2. (1) Notwithstanding the amendments to ORS
197.030 by section 1 of this 1999 Act, a person who is serving on the Land
Conservation and Development Commission on the effective date of this 1999 Act
is authorized to serve for the full length of the person's appointed term and
shall be eligible for reappointment if the person would otherwise be eligible
for reappointment under ORS 197.030 (3) (1997 Edition).
(2) Of the seats on the
commission that become available following the effective date of this 1999 Act
due to vacancy or the scheduled completion of a serving member's term, the
Governor shall appoint persons to the open seats in the following order of priority:
(a) First, a person
representing Clatsop, Columbia, Coos, Curry, Lincoln and Tillamook Counties and
those portions of Douglas and Lane Counties lying west of the summit of the
Coast Range;
(b) Second, a person
representing Jackson and Josephine Counties and that portion of Douglas County
lying east of the summit of the Coast Range;
(c) Third, a person
representing Benton, Linn, Marion, Polk and Yamhill Counties and that portion
of Lane County lying east of the summit of the Coast Range;
(d) Fourth, a person
representing Clackamas, Multnomah and Washington Counties;
(e) Fifth, a person
representing Baker, Crook, Deschutes, Gilliam, Grant, Harney, Hood River,
Jefferson, Klamath, Lake, Malheur, Morrow, Sherman, Umatilla, Union, Wallowa,
Wasco and Wheeler Counties;
(f) Sixth, a person
representing Benton, Clackamas, Linn, Marion, Multnomah, Polk, Washington and
Yamhill Counties and that portion of Lane County lying east of the summit of
the Coast Range; and
(g) Seventh, a person
representing Clackamas, Multnomah and Washington Counties.
(3) The Governor shall
ensure that ORS 197.030, as amended by section 1 of this 1999 Act, is fully
implemented by June 30, 2004.
