Relating to standards for
storm water treatment.
Be It Enacted by the People of the State of Oregon:
SECTION 1. (1) The President of the Senate and the
Speaker of the House of Representatives shall direct the appropriate interim
committee to study issues related to the management of storm water and sediment
control in Oregon.
(2) The committee shall
study the management of storm water and sediment control by land developers,
home builders, builders of commercial and industrial property and other private
and public sector construction site owners and operators. The study shall
include but need not be limited to the following issues related to storm water
management:
(a) The need for general
standards for local governments to follow in adopting local storm water runoff
regulations;
(b) The establishment of a
set of risk factors to be applied to a site that will be used to determine
storm water management problems and solutions at the site and fees tied to such
risk factors;
(c) Whether to restrict the
level of fees a local government may impose to the level of risk posed by a
site;
(d) Whether to require local
governments to levy a fee to fund the state's participation in ongoing
monitoring of local storm water management programs and regulations;
(e) The development of a set
of model rules for local government storm water management programs; and
(f) Whether a different
regulatory structure should be applied to small sites located within urban
growth boundaries.
(3) The committee shall use
the services of permanent legislative staff to the greatest extent practicable.
All agencies, departments and officers of this state are directed to assist the
committee in the performance of its functions, and to furnish such information
and advice as the members of the committee consider necessary to perform their
functions.
SECTION 2. Section 1 of this 1999 Act is repealed on
December 31, 2001.
