Relating to state agency
name change; creating new provisions; and amending ORS 180.340.
Be It Enacted by the People of the State of Oregon:
SECTION 1.
ORS 180.340, as amended by section 48, chapter 704, Oregon Laws 1997, is
amended to read:
180.340. (1) There is established the [Support Enforcement] Division of
Child Support of the Department of Justice to be maintained, operated and
controlled under the supervision of the Attorney General. The Attorney General
may employ attorneys, investigators and other personnel necessary to carry out
the duties and functions of the division and fix their compensation, subject to
any applicable provision of the State Personnel Relations Law.
(2) The Department of Justice may adopt rules specific to the
functions contracted solely to the [Support
Enforcement] Division of Child
Support provided the rules do not conflict with rules adopted by the
Department of Human Resources or with federal or state law.
SECTION 2. Any business or legal proceedings of the
Division of Child Support may be conducted in the name of the Support
Enforcement Division until the Attorney General determines that the cost of
conducting business and legal proceedings in the name of the Division of Child
Support is no longer material to the Department of Justice.
SECTION 3. (1) The amendments to ORS 180.340 by
section 1 of this 1999 Act are intended to change the name of the Support
Enforcement Division of the Department of Justice to the Division of Child
Support.
(2) For the purpose of
harmonizing and clarifying statute sections printed in Oregon Revised Statutes,
the Legislative Counsel may substitute for words designating the Support
Enforcement Division, wherever they occur in Oregon Revised Statutes, other
words designating the Division of Child Support.
