AN ACT

 

SB 5539

 

Relating to the financial administration of the Water Resources Department; appropriating money; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

      SECTION 1. There is appropriated to the Water Resources Department, for the biennium beginning July 1, 1999, out of the General Fund, the amount of $20,150,394 for water resources programs.

      SECTION 2. (1) In addition to and not in lieu of any other appropriation, there is appropriated to the Water Development Administration and Bond Sinking Fund, out of the General Fund, the sum of $550,000.

      (2) The appropriation made by subsection (1) of this section is available continuously until expended for the purposes specified in ORS 541.830 (1)(c).

      SECTION 3. Notwithstanding any other law, the following amounts are established for the biennium beginning July 1, 1999, as the maximum limits for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, including federal funds received under cooperative agreements or contracts, but excluding lottery funds, collected or received by the Water Resources Department:

 

      (1)     Water Resources Program..................... $           3,776,461

      (2)     Water Development Loan

               Fund Administration.............................. $              437,948

 

      SECTION 4. Notwithstanding any other law, the amount of $215,000 is established for the biennium beginning July 1, 1999, as the maximum limit for payment of expenses from federal grant funds collected or received by the Water Resources Department.

      SECTION 5. Section 2 of this 1999 Act does not limit, affect or apply to expenditures for debt service and loans for water development projects.

      SECTION 6. (1) In addition to and not in lieu of any other appropriation, there is appropriated to the Emergency Board, for the biennium beginning July 1, 1999, out of the General Fund, the sum of $125,000, for allocation only to the Water Resources Department for water resources programs as described in subsection (2) of this section.

      (2) Allocations under this section shall be reserved for the following purposes:

      (a) For groundwater studies, $100,000.

      (b) For the Deschutes Water Management Planning process, $25,000.

      (3) If all of the moneys referred to in subsection (1) of this section are not allocated by the Emergency Board prior to November 1, 2000, the remaining moneys on that date become available for any other purpose for which the Emergency Board lawfully may allocate funds.

      SECTION 7. Notwithstanding any other law limiting expenditures of the Water Resources Department for the payment of expenses from federal funds collected or received by the Water Resources Department for the biennium ending June 30, 1999, the limitation on expenditures established by section 4, chapter 622, Oregon Laws 1997, as modified by Emergency Board action, is increased by $130,000.

      SECTION 8. Notwithstanding any other law, all sections of this 1999 Act are subject to Oregon Department of Administrative Services rules related to allotting, controlling, and encumbering funds.

      SECTION 9. This 1999 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 1999 Act takes effect on its passage.
