Relating to underground
storage tank permit fee; creating new provisions; amending ORS 466.785; and
limiting expenditures.
Be It Enacted by the People of the State of Oregon:
SECTION 1.
ORS 466.785 is amended to read:
466.785. (1) [Fees may be
required of] Every underground
storage tank permittee [of an
underground storage tank. Fees shall be in an amount determined by the
Environmental Quality Commission to be adequate to carry on the duties of the
Department of Environmental Quality or the duties of a state agency or local
unit of government that has contracted with the department under ORS 466.730.
Such fees shall not exceed $35]
shall pay a fee in the amount of $60 per tank per year.
(2) Fees collected by the Department of Environmental Quality under this section shall be deposited in
the State Treasury to the credit of an account of the department. All fees paid
to the department shall be continuously appropriated to the department to carry
out the provisions of ORS 466.706 to 466.845 and 466.994.
SECTION 2. The amendments to ORS 466.785 by section 1
of this 1999 Act become operative December 31, 1999.
SECTION 3.
ORS 466.785, as amended by section 1 of this 1999 Act, is amended to read:
466.785. (1) Every underground storage tank permittee shall pay
a fee in the amount of [$60] $35 per tank per year.
(2) Fees collected by the Department of Environmental Quality
under this section shall be deposited in the State Treasury to the credit of an
account of the department. All fees paid to the department shall be
continuously appropriated to the department to carry out the provisions of ORS
466.706 to 466.845 and 466.994.
SECTION 4. The amendments to ORS 466.785 by section 3
of this 1999 Act become operative December 31, 2001.
SECTION 5. Notwithstanding any other law, the amount
of $330,779 is established for the biennium beginning July 1, 1999, as the
maximum limit for payment of expenses in carrying out the provisions of ORS
466.706 to 466.845 and 466.994 from fees, moneys or other revenues, including
Miscellaneous Receipts, excluding federal funds, collected or received by the
Department of Environmental Quality.
