AN ACT
HB 5016
Relating to the financial
administration of the Department of Education; appropriating money; limiting
expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. There is appropriated to the Department of
Education, for the biennium beginning July 1, 1999, out of the General Fund,
the following amounts for the following purposes:
(1) Operations............................................... $ 36,702,786
(2) Oregon State Schools for
the Deaf and for
the Blind..................... $ 14,476,164
SECTION 2. Notwithstanding any other law, the
following amounts are established for the biennium beginning July 1, 1999, as
the maximum limits for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Department of Education, for the following
purposes:
(1) Operations............................................... $ 5,624,317
(2) Oregon State Schools for
the Deaf and for
the Blind..................... $ 2,931,597
(3) Youth Corrections
Education program................................. $ 20,640,067
SECTION 3. Notwithstanding any other law, the amount
of $2,463,139 is established for the biennium beginning July 1, 1999, as the
maximum limit for payment of expenses from moneys collected or received by the
Department of Education, from the United States Department of Education and
United States Department of Agriculture for central management services.
SECTION 4. Notwithstanding any other law, the
following amounts are established for the biennium beginning July 1, 1999, as
the maximum limits for the payment of expenses from federal funds collected or
received by the Department of Education, for the following purposes:
(1) Operations............................................... $ 30,404,748
(2) Oregon State Schools for
the Deaf and for
the Blind..................... $ 290,074
(3) Youth Corrections
Education program................................. $ 2,956,838
SECTION 5. In addition to and notwithstanding any
other law, the amount of $30,781,120 is established for the biennium beginning
July 1, 1999, as the maximum limit for payment of expenses by the Department of
Education from the Lottery Bond Fund for debt service on the outstanding state
education lottery bonds issued during the 1997-1999 biennium.
SECTION 6. (1) Notwithstanding any other law limiting
expenditures of the Department of Education, the amount of $2,644,490 is
established for the biennium beginning July 1, 1999, as the maximum limit for
payment of expenses by the Department of Education from the Lottery Bond Fund
for issuance costs of state education lottery bonds issued during the 1999-2001
biennium.
(2) In addition to and
notwithstanding any other law, the amount of $10,872,000 is established for the
biennium beginning July 1, 1999, as the maximum limit for payment of expenses
by the Department of Education from the Lottery Bond Fund for debt service on
the outstanding state education lottery bonds issued during the 1999-2001
biennium.
SECTION 7. (1) In addition to and not in lieu of any
other appropriation, there is appropriated to the Emergency Board, out of the
General Fund, for the biennium beginning July 1, 1999, the following sums for
allocation to the Department of Education, for the following purposes:
(a) Student assessment system..................... $ 1,000,000
(b) Salary increases for education
program managers
and education
program specialists.................................. $
405,517
(2) If any of the moneys
described in subsection (1) of this section are not allocated or obligated by
the Emergency Board prior to November 1, 2000, such unallocated and unobligated
moneys on that date become available for any other purpose for which the
Emergency Board may lawfully allocate funds.
SECTION 8. There shall be transferred on or before
July 15, 1999, to the Department of Education by the Motor Vehicles Division of
the Department of Transportation, out of the Motor Vehicles Division Suspense
Account, the sum of $92,987 for training and education related traffic safety
and school safety patrols.
SECTION 9. Section 2 of this 1999 Act does not limit,
affect or apply to distribution of costs related to the School Lunch Revolving
Account, Education Training Revolving Account, Private Vocational School
Tuition Protection Fund, and Distance Learning Fund; and expenditures made from
donations received by the Oregon State School for the Blind and Oregon State
School for the Deaf.
SECTION 10. Notwithstanding any other law, all sections
of this 1999 Act are subject to Oregon Department of Administrative Services
rules related to allotting, controlling, and encumbering funds.
SECTION 11. This 1999 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 1999 Act takes effect July 1, 1999.
