AN ACT
HB 5017
Relating to state financial
administration of grants-in-aid; appropriating money; limiting expenditures;
and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. There is appropriated to the Department of
Education, for the biennium beginning July 1, 1999, out of the General Fund,
the following amounts which are to be distributed as grants-in-aid and to
purchase services, for the following purposes:
(1) Early Intervention programs................. $ 68,185,583
(2) Educating children with
disabilities in
regional
programs pursuant
to
ORS 343.236............................................ $ 37,177,262
(3) Educating children with
disabilities in
hospital
programs.................................................. $ 2,093,069
(4) Educating children with
disabilities in
Long Term
Treatment Program................................ $ 17,732,449
(5) Oregon Prekindergarten
program................................................... $ 45,706,457
(6) Together for Children............................ $ 591,127
(7) Talented and Gifted Programs.............. $ 214,955
(8) Student Leadership Centers.................. $ 716,058
(9) Workforce Development........................ $ 184,138
(10) Staff Development.................................. $ 1,016,638
(11) Structure of Intellect............................... $ 1,500,000
(12) Applied Behavioral
Analysis Treatment
Program
for Children with

(13) American Sports

SECTION 2. Notwithstanding any other law, the
following amounts are established for the biennium beginning July 1, 1999, as
the maximum limits for the payment of grants-in-aid and purchased services from
fees, moneys or other revenues, including Miscellaneous Receipts, but excluding
lottery funds and federal funds, collected or received by the Department of
Education for the following purposes:
(1) Student driver training........................... $ 2,418,006
(2) Other grant programs............................ $ 14,477,234
SECTION 3. Notwithstanding any other law, the
following amounts are established for the biennium beginning July 1, 1999, as
the maximum limits for the payment of grants-in-aid and purchased services from
federal funds received by the Department of Education:
(1) From funds received from
the United States
Department of
Education and
other federal
agencies other
than the United
States
Department of
Agriculture with
the exception of
the Nutrition
Education Program ............................... $ 368,574,357
(2) From funds received from
the United States
Department of Agriculture.................... $ 178,130,544
SECTION 4. (1) In addition to and not in lieu of any
other appropriation, there is appropriated to the Emergency Board, out of the
General Fund, for the biennium beginning July 1, 1999, the following sums for
allocation to the Department of Education, for the following purposes:
(a) Early Intervention programs................. $ 10,052,682
(b) Oregon Prekindergarten
program................................................... $ 345,000
(c) Junior Achievement................................ $ 90,000
(2) If any of the moneys
described in subsection (1) of this section are not allocated or obligated by
the Emergency Board prior to November 1, 2000, such unallocated and unobligated
moneys on that date become available for any other purpose for which the
Emergency Board may lawfully allocate funds.
SECTION 5. Notwithstanding any other law limiting
expenditures of the Department of Education for payment of expenses from
federal funds for the biennium ending June 30, 1999, the limitation on
expenditures established by section 4 (2), chapter 335, Oregon Laws 1997, as
modified by the Emergency Board, for school nutrition programs is increased by
$5,300,000.
SECTION 6. Notwithstanding any other law, all sections
of this 1999 Act are subject to Oregon Department of Administrative Services
rules related to allotting, controlling, and encumbering funds.
SECTION 7. This 1999 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 1999 Act takes effect July 1, 1999.
