AN ACT
HB 5019
Relating to the financial
administration of the Department of Environmental Quality; appropriating money;
limiting expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. There is appropriated to the Department of
Environmental Quality, for the biennium beginning July 1, 1999, out of the
General Fund, the amount of $34,314,903.
SECTION 2. Notwithstanding any other law, the amount
of $102,233,428 is established for the biennium beginning July 1, 1999, as the
maximum limit for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, but excluding lottery funds and federal
funds, including the proceeds of bonds for the Orphan Site Account, collected
or received by the Department of Environmental Quality.
SECTION 3. Section 2 of this 1999 Act does not limit,
affect or apply to expenditures for debt service paid from Other Funds or for
loans made from the Pollution Control Fund or for loans made from the Water
Pollution Control Revolving Fund.
SECTION 4. Notwithstanding any other law, the amount
of $32,169,554 is established for the biennium beginning July 1, 1999, as the
maximum limit for the payment of expenses from federal funds collected or
received by the Department of Environmental Quality.
SECTION 5. Notwithstanding any other law, the amount
of $403,765 is established for the biennium beginning July 1, 1999, as the
maximum limit for the payment of expenses from lottery moneys allocated from
the parks and natural resources fund to the Department of Environmental Quality
for activities and projects to implement section 4 (5), Article XV of the
Oregon Constitution.
SECTION 6. (1) In addition to and not in lieu of any
other appropriation, there is appropriated to the Emergency Board, for the
biennium beginning July 1, 1999, out of the General Fund, the sum of $750,000
for allocation only to the Department of Environmental Quality for agency
operations related to Oregon Plan activities.
(2) If all of the moneys
referred to in subsection (1) of this section are not allocated by the
Emergency Board prior to November 1, 2000, the remaining moneys on that date
become available for any other purpose for which the Emergency Board lawfully
may allocate funds.
SECTION 7. Notwithstanding any other law, all sections
of this 1999 Act are subject to Oregon Department of Administrative Services
rules related to allotting, controlling, and encumbering funds.
SECTION 8. This 1999 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 1999 Act takes effect July 1, 1999.
