AN ACT

 

HB 5024

 

Relating to the financial administration of the State Forestry Department; appropriating money; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

      SECTION 1. There is appropriated to the State Forestry Department, for the biennium beginning July 1, 1999, out of the General Fund, the following amounts for the following purposes:

 

      (1)     Agency administration............................ $           7,052,237

      (2)     Protection from fire................................ $         15,947,695

      (3)     Forestry assistance.................................. $           1,255,307

      (4)     Forest practices....................................... $           7,045,929

      (5)     Capital improvement.............................. $                85,982

      (6)     Debt service............................................. $              941,157

 

      SECTION 2. Notwithstanding any other law, the following amounts are established for the biennium beginning July 1, 1999, as the maximum limits for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but including federal funds for fire protection, excluding lottery funds, collected or received by the State Forestry Department, for the following purposes:

 

      (1)     Agency administration............................ $         11,183,642

      (2)     Protection from fire................................ $         43,888,444

      (3)     State-owned forest lands........................ $         53,207,332

      (4)     Forestry assistance.................................. $           3,088,937

      (5)     Forest practices operations..................... $           5,736,056

      (6)     Capital improvement.............................. $           3,215,428

      (7)     Debt service............................................. $              573,293

 

      SECTION 3. Notwithstanding any other law, the amount of $352,557 is established for the biennium beginning July 1, 1997, as the maximum limit for payment of expenses from lottery moneys allocated from the Administrative Services Economic Development Fund to the State Forestry Department for activities of the Forest Resource Trust.

      SECTION 4. Notwithstanding any other law, the amount of $3,295,563 is established for the biennium beginning July 1, 1999, as the maximum limit for the payment of expenses from federal funds collected or received by the State Forestry Department.

      SECTION 5. Section 2 of this 1999 Act does not limit, affect or apply to expenditures for the Nursery Revolving Fund or the Equipment Pool Revolving Fund.

      SECTION 6. Section 2 of this 1999 Act does not limit, affect or apply to expenditures for the equalization of emergency fire suppression costs from the Oregon Forest Land Protection Fund or the purchase of insurance referred to in ORS 477.775. This 1999 Act does not limit, affect or apply to expenditures for fire cost claims.

      SECTION 7. Notwithstanding any other law, all sections of this 1999 Act are subject to Oregon Department of Administrative Services rules related to allotting, controlling, and encumbering funds.

      SECTION 8. This 1999 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 1999 Act takes effect on its passage.
