AN ACT
HB 5047
Relating to the financial
administration of the Department of Land Conservation and Development;
appropriating money; limiting expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. There is appropriated to the Department of
Land Conservation and Development, for the biennium beginning July 1, 1999, out
of the General Fund, amounts for the following purposes:
(1) Operations............................................... $ 6,117,947
(2) Grant Programs...................................... $ 2,371,575
(3) Landowner Notification......................... $ 500,000
SECTION 2. Notwithstanding any other law, the
following amounts are established for the biennium beginning July 1, 1999, as
the maximum limits for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Department of Land Conservation and
Development for the following purposes:
(1) Operations............................................... $ 2,708,008
(2) Grant Programs...................................... $ 91,376
SECTION 3. Notwithstanding any other law, the
following amounts are established for the biennium beginning July 1, 1999, as
the maximum limits for the payment of expenses from federal funds collected or
received by the Department of Land Conservation and Development, for the
following purposes:
(1) Operations............................................... $ 3,803,679
(2) Grant Programs...................................... $ 485,716
SECTION 4. (1) In addition to and not in lieu of any
other appropriation, there is appropriated to the Emergency Board, for the
biennium beginning July 1, 1999, out of the General Fund, the sum of $450,000
for allocation only to the Department of Land Conservation and Development for
grant programs as described in subsection (2) of this section.
(2) Allocations under this
section shall be reserved for the following purposes:
(a) $250,000 for technical
assistance and periodic review grants.
(b) $200,000 for regional
problem solving grants, including but not limited to farmland mapping projects.
(3) If any of the moneys
referred to in subsection (1) of this section are not allocated by the
Emergency Board prior to November 1, 2000, the remaining moneys on that date
become available for any other purpose for which the Emergency Board lawfully
may allocate funds.
SECTION 5. The appropriations made from the General
Fund under chapter 667, Oregon Laws 1997, as modified by the Emergency Board,
for the biennium ending June 30, 1999, to the Department of Land Conservation
and Development for landowner notification programs are reduced by $495,000.
SECTION 6. Notwithstanding any other law, all sections
of this 1999 Act are subject to Oregon Department of Administrative Services
rules related to allotting, controlling, and encumbering funds.
SECTION 7. This 1999 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 1999 Act takes effect on its passage.
