AN ACT

 

HB 5049

 

Relating to the financial administration of the State Scholarship Commission; appropriating money; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

      SECTION 1. There is appropriated to the State Scholarship Commission, for the biennium beginning July 1, 1999, out of the General Fund, the amount of $33,216,626.

      SECTION 2. Notwithstanding any other law, the amount of $13,419,694 is established for the biennium beginning July 1, 1999, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts and revenues for administration and operation of the Federal Family Education Loans Program, but excluding lottery funds, federal funds and interest earned on the Education Endowment Fund for need grants, collected or received by the State Scholarship Commission.

      SECTION 3. Notwithstanding any other law, the amount of $656,146 is established for the biennium beginning July 1, 1999, as the maximum limit for payment of expenses from federal funds collected or received by the State Scholarship Commission.

      SECTION 4. In addition to and notwithstanding any other law, the amount of $4,258,088 is established for the biennium beginning July 1, 1999, as the maximum limit for payment of expenses by the State Scholarship Commission from interest earned on the Education Endowment Fund for need grants.

      SECTION 5. Section 2 of this 1999 Act does not limit, affect or apply to expenditures to purchase defaulted loans from lenders; to reimburse the federal portion of collections on defaulted loans; to pay collection agency charges; to make disbursements of grants from private and special scholarship accounts as established by the Legislative Assembly; and to make disbursements of educational benefits to students as established by the Legislative Assembly.

      SECTION 6. (1) In addition to and not in lieu of any other appropriation, there is appropriated to the Emergency Board, out of the General Fund, for the biennium beginning July 1, 1999, the sum of $75,000 for allocation to the State Scholarship Commission for the Medical-Dental Loan Program.

      (2) If any of the moneys described in subsection (1) of this section are not allocated or obligated by the Emergency Board prior to November 1, 2000, such unallocated and unobligated moneys on that date become available for any other purpose for which the Emergency Board may lawfully allocate funds.

      SECTION 7. Notwithstanding any other law, all sections of this 1999 Act are subject to Oregon Department of Administrative Services rules related to allotting, controlling, and encumbering funds.

      SECTION 8. This 1999 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 1999 Act takes effect July 1, 1999.
