AN ACT
HB 5061
Relating to state financial
administration; appropriating money; limiting expenditures; and declaring an
emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. There is appropriated to the Department of
Higher Education for the biennium beginning July 1, 1999, out of the General
Fund, the amount of $609,050,116, which may be expended for support of
education and general services of higher education.
SECTION 2. Notwithstanding any other law, the amount
of $601,804,587 is established for the biennium beginning July 1, 1999, as the
maximum limit for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, but excluding lottery funds and federal funds,
collected or received by the Department of Higher Education for support of
education and general services of higher education.
SECTION 3. (1) In addition to and not in lieu of any
other appropriation, there is appropriated to the Emergency Board, out of the
General Fund, for the biennium beginning July 1, 1999, for allocation to the
Department of Higher Education to support:
(a) Additional funding for
state institutions
of higher
education that
successfully
meet performance
targets....................... $ 730,000
(b) The Oregon Wide Area
Network................................................... $ 1,630,000
(c) The Oregon Engineering
Education
Investment
Fund established
under
ORS 351.666............................................ $ 5,000,000
(2) If any of the moneys
described in subsection (1) of this section are not allocated or obligated by
the Emergency Board prior to November 1, 2000, such unallocated and unobligated
moneys on that date become available for any other purpose for which the
Emergency Board may lawfully allocate funds.
SECTION 4. Sections 1 and 2 of this 1999 Act do not
prohibit the Department of Higher Education or the State Board of Higher
Education from expending moneys in addition to the appropriations and
limitations made by sections 1 and 2 of this 1999 Act if such additional moneys
are otherwise available as provided by law for expenditure by the department or
board for gift, grant and contract activities, auxiliary enterprise activities
and student loans.
SECTION 5. Notwithstanding any other law, the amount
of $4,886,091 is established for the biennium beginning July 1, 1999, as the
maximum limit for payment of expenses from funds allocated to the Department of
Higher Education from the Sports Lottery Account.
SECTION 6. In addition to and not in lieu of any other
appropriation, there is appropriated to the Department of Higher Education, for
the biennium beginning July 1, 1999, out of the General Fund, the sum of
$18,317,636, which may be expended only for debt service and administrative
costs relating to debt service on outstanding general obligation bonds sold
pursuant to Article XI-G of the Oregon Constitution.
SECTION 7. In addition to and not in lieu of any other
appropriation, there are appropriated to the Department of Higher Education,
for the biennium beginning July 1, 1999, out of the General Fund, the following
amounts, which may be expended only for the following purposes:
(1) For support of the
Agricultural Experiment Station and the branch experiment stations of Oregon
State University, $52,453,236.
(2) For support of the
Extension Service of Oregon State University, $35,609,938.
(3) For support of the
Forest Research Laboratory of Oregon State University, $5,005,151.
SECTION 8. Notwithstanding any other law, the
following amounts are established for the biennium beginning July 1, 1999, as
the maximum limits for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Department of Higher Education, for the
following purposes:
(1) For support of the
Agricultural Experiment Station and the branch experiment stations of Oregon
State University, $14,489,620.
(2) For support of the
Extension Service of Oregon State University, $21,605,633.
(3) For support of the
Forest Research Laboratory of Oregon State University, $9,945,284.
SECTION 9. Sections 7 and 8 of this 1999 Act do not
prohibit the Department of Higher Education or the State Board of Higher
Education from expending moneys in addition to the appropriations and
limitations made by sections 7 and 8 of this 1999 Act if such additional moneys
are otherwise available as provided by law for expenditure by the department or
board for gift, grant and contract activities and auxiliary enterprise
activities.
SECTION 10. If House Bill 5057 becomes law, sections 7,
8 and 9 of this 1999 Act are repealed.
SECTION 11. Notwithstanding any other law, sections 1
to 5 and 7 to 10 of this 1999 Act are subject to Oregon Department of
Administrative Services rules related to allotting, controlling and encumbering
funds.
SECTION 12. This 1999 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 1999 Act takes effect July 1, 1999.
