AN ACT

 

HB 5053

 

Relating to the financial administration of the Department of Transportation; appropriating money; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

      SECTION 1. There is appropriated to the Department of Transportation, for the biennium beginning July 1, 1999, out of the General Fund, the following amounts for the following purposes:

 

      (1)     Transportation development.................. $              204,502

      (2)     Driver and Motor Vehicle

               Services.................................................... $              143,168

      (3)     Rail........................................................... $                90,000

      (4)     Public Transit.......................................... $                30,000

 

      SECTION 2. Notwithstanding any other law, the following amounts are established for the biennium beginning July 1, 1999, as the maximum limits for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts and federal funds received as reimbursement from the United States Department of Transportation, Federal Highway Administration and Federal Aviation Administration under the Transportation Equity Act for the 21st Century, but excluding lottery funds, collected or received by the Department of Transportation, to be expended for the following purposes:

 

      (1)     Maintenance program............................ $       292,859,876

      (2)     Preservation program............................. $       285,468,525

      (3)     Bridge program....................................... $       141,721,552

      (4)     Highway safety program........................ $         49,488,166

      (5)     Operations program............................... $         17,493,979

      (6)     Modernization program......................... $       202,645,297

      (7)     Highway planning

               and research............................................ $         17,321,297

      (8)     Special programs..................................... $       140,682,748

      (9)     Emergency relief program..................... $           5,470,353

      (10)   Local government program................... $       181,655,654

      (11)   Driver and Motor Vehicle

               Services.................................................... $       123,667,602

      (12)   Motor carrier transportation................. $         37,825,669

      SECTION 3. Notwithstanding any other law, the following amounts are established for the biennium beginning July 1, 1999, as the maximum limits for payment of expenses from federal funds collected or received by the Department of Transportation, other than those funds received as reimbursement from the United States Department of Transportation, Federal Highway Administration and Federal Aviation Administration under the Transportation Equity Act for the 21st Century, to be expended for the following purposes:

 

      (1)     Transportation development.................. $              161,442

      (2)     Motor carrier transportation................. $           2,430,659

      (3)     Central services....................................... $              187,897

      (4)     Public transit........................................... $         11,301,931

      (5)     Rail........................................................... $         14,428,024

      (6)     Transportation safety............................. $         12,547,361

 

      SECTION 3a. If House Bill 2082 becomes law, section 2 of this 1999 Act is amended to read:

      Sec. 2. Notwithstanding any other law, the following amounts are established for the biennium beginning July 1, 1999, as the maximum limits for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts and federal funds received as reimbursement from the United States Department of Transportation, Federal Highway Administration and Federal Aviation Administration under the Transportation Equity Act for the 21st Century, but excluding lottery funds, collected or received by the Department of Transportation, to be expended for the following purposes:

 

      (1)     Maintenance program.............................. [$      292,859,876]

      SECTION 4. Notwithstanding any other law, the amount of $19,993,390 is established for the biennium beginning July 1, 1999, as the maximum limit for payment of expenses from lottery moneys allocated from the Administrative Services Economic Development Fund to the Department of Transportation for Westside Light Rail debt service.

      SECTION 5. Section 2 of this 1999 Act does not limit, affect or apply to expenditures for debt service, internally reimbursed expenditures, or costs related to rate setting hearings conducted by the Oregon Board of Maritime Pilots.

      SECTION 6. Notwithstanding any other law, all sections of this 1999 Act are subject to Oregon Department of Administrative Services rules related to allotting, controlling, and encumbering funds.

      SECTION 7. This 1999 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 1999 Act takes effect July 1, 1999.
