AN ACT

 

SB 5527

 

Relating to state financial administration; appropriating money; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

      SECTION 1. In addition to and not in lieu of any other appropriation, there is appropriated to the Oregon Military Department out of the General Fund, for the biennium beginning July 1, 1999, the following amounts for the acquisition of land and the acquisition, planning, constructing, altering, repairing, furnishing, and equipping, of buildings and facilities:

 

      (1)     Armed Forces Reserve

      SECTION 2. In addition to and not in lieu of any other appropriation, there is appropriated to the State Parks and Recreation Department, for the biennium beginning July 1, 1999, out of the General Fund, the amount of $1 for the purpose of identifying sites in Washington County that are suitable for a state park, including the performance of initial planning and the purchase of options on real property.

      SECTION 3. Notwithstanding any other law, the following amounts are established for the biennium beginning July 1, 1999, as the maximum limits for the payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by various state agencies for the acquisition of land and the acquisition, planning, constructing, altering, repairing, furnishing and equipping of buildings and facilities:

      SECTION 4. Notwithstanding any other law, the following amounts are established for the biennium beginning July 1, 1999, as the maximum limits for payment of expenses from moneys collected or received by the Department of Transportation from the Federal Aviation Administration and from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds, for airport projects:

 

      (1)     Aurora

      SECTION 5. Notwithstanding any other law, the following amounts are established for the biennium beginning July 1, 1999, as the maximum limits for the expenditure of federal funds collected or received by various state agencies for the acquisition of land and the acquisition, planning, constructing, altering, repairing, furnishing and equipping of buildings and facilities:

      SECTION 6. Notwithstanding any other law limiting amounts for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Department of Corrections, the capital construction expenditure limitation established by Emergency Board action in January 1997, as modified by section 5 (1), chapter 624, Oregon Laws 1997, and as further modified by Emergency Board action in January 1998 and June 1998, for construction of a women's prison and intake center in Wilsonville or the Wilsonville Urban Reserve, is decreased by $154,948,881.

      SECTION 7. Notwithstanding any other law, the amount of $171,721,178 is established for the biennium beginning July 1, 1999, as the maximum limit for the payment of expenses from fees, proceeds from the issuance of certificates of participation or other financing agreements, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Department of Corrections for the acquisition of land and the planning, construction, alteration, repair, furnishing and equipping of buildings and facilities for a women's correctional facility and intake center complex at any site in this state other than the real property known as the F. H. Dammasch State Hospital.

      SECTION 8. Notwithstanding any other law limiting expenditures from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Oregon Youth Authority, the limitations on expenditures established by law, as modified by Emergency Board action, are adjusted as follows:

      (1) The expenditure limitation established by section 1 (4)(a), chapter 624, Oregon Laws 1997, for fences at MacLaren and Hillcrest Youth Correctional Facilities is increased by $100,000.

      (2) The expenditure limitation established by section 1 (4)(b), chapter 624, Oregon Laws 1997, for furnishings and landscaping for regional facilities is decreased by $100,000.

      (3) The expenditure limitation established by action of the Emergency Board in January 1998 for construction of a youth accountability camp is increased by $300,000.

      SECTION 9. Notwithstanding any other law, the following amounts are established for the biennium beginning July 1, 1999, as the maximum limits for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Department of Corrections for the acquisition of land and the construction, acquisition, planning, expansion or remodeling of local correctional facilities for the following counties:

 

      (1)     Klamath................................................. $1

      SECTION 10. (1) The Department of Corrections Account is established in the General Fund of the State Treasury. Except for moneys otherwise designated by statute, all fees, assessments, proceeds from the issuance of certificates of participation and other moneys received by the Department of Corrections shall be paid into the State Treasury and credited to the account. All moneys in the account are continuously appropriated to the department for purposes authorized by law.

      (2) The department shall keep a record of all moneys deposited in the account. The record shall indicate by separate cumulative accounts the sources from which the moneys are derived and the individual activity or program against which each withdrawal is charged.

      (3) The department may accept gifts, grants and donations from any source to carry out the duties imposed upon the department.

      SECTION 11. Within the expenditure limitation made by section 3 (1) of this 1999 Act, the amount of $1,120,000 is included for the Employment Department from funds made available to this state under section 903 of the Social Security Act, as amended, to acquire, subject to the provisions of ORS 657.657 and 657.812, land and improvements thereon for the use of the department and for such improvements, facilities, paving, landscaping and fixed equipment as may be required for its use and operation.

      SECTION 12. The amounts in section 3 of this 1999 Act do not limit, affect or apply to any expenditures by the departments for interest payments while the facilities are under construction, bond counsel and underwriters' fees, legal fees or other fees associated with financing as may be required by the financial institutions.

      SECTION 13. (1) The project approvals, appropriations, or expenditure limitations in this 1999 Act, unless otherwise noted, or changed by the Emergency Board or Legislative Assembly, expire on June 30, 2005.

      (2) All project approvals and appropriation or expenditure limitation balances on the records of the Oregon Department of Administrative Services authorized by Emergency Board action or the Legislative Assembly expire on the later of June 30, 2001, or six years from the effective dates of the authorizing Acts.

      SECTION 14. Notwithstanding any other law, all sections of this 1999 Act are subject to Oregon Department of Administrative Services rules related to allotting, controlling, and encumbering funds.

      SECTION 15. This 1999 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 1999 Act takes effect on its passage.
