AN ACT

 

SB 5511

 

Relating to state financial administration; creating new provisions; amending section 6, chapter 887, Oregon Laws 1999 (Enrolled House Bill 5016), and sections 1, 2, 5, 6 and 7, chapter 914, Oregon Laws 1999 (Enrolled House Bill 5018); repealing section 13, chapter 908, Oregon Laws 1999 (Enrolled House Bill 5038); appropriating money; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

      SECTION 1. (1) In addition to and not in lieu of any other appropriation, there is appropriated to the Emergency Board, out of the General Fund, for the biennium beginning July 1, 1999, the amount of $41,900,000 for the purposes for which the Emergency Board lawfully may allocate such money.

      (2)(a) In addition to and not in lieu of any other appropriation, there is appropriated to the Emergency Board, out of the General Fund, for the biennium beginning July 1, 1999, the following sums to be allocated by the Emergency Board to affected state agencies for the purpose of paying:

 

      (A)    To the Office of Energy for the

               Oregon Museum of Science and

               Industry................................................... $           1,425,000

      (B)    To the Department of

               Education for student

               assessment centers or

               other school reform uses......................... $           3,000,000

      (C)    To the Housing and

               Community Services

               Department for migrant

               housing..................................................... $           1,000,000

      (D)    To the Judicial Department

               for carrying out the

               purposes of chapter 1041,

               Oregon Laws 1999

               (Enrolled Senate Bill 38)......................... $              200,000

      (E)    To the State School Fund,

               in the event Senate Bill

               1284 becomes law prior

               to January 1, 2001, for

               distribution to school

               districts, or to the Department

               of Transportation, in the event

               Senate Bill 1284 does not

               become law by January 1,

               2001, for high speed rail

               and elderly and disabled

      (F)    To the Legislative Revenue

               Officer for a task force on

               tax incidence study and

               modeling for the purpose of

               acquiring a full tax

      (b) If any of the moneys appropriated in paragraph (a) of this subsection are not allocated by the Emergency Board prior to November 1, 2000, the remaining moneys on that date become available for any other purpose for which the Emergency Board lawfully may allocate funds.

      SECTION 2. In addition to and not in lieu of any other appropriation, there is appropriated to the Department of Revenue, for the biennium beginning July 1, 1999, the amount of $5,000,000, out of the General Fund, for the purposes specified in section 6, chapter 796, Oregon Laws 1989, as amended by section 2a, chapter 701, Oregon Laws 1999 (Enrolled House Bill 2139). The amount appropriated under this section shall be deposited in the County Assessment Function Funding Assistance Account.

      SECTION 3. There is appropriated to the Bureau of Labor and Industries, for the biennium beginning July 1, 1999, out of the General Fund, the amount of $12,459,682.

      SECTION 4. Notwithstanding any other law, the amount of $3,746,131 is established for the biennium beginning July 1, 1999, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Bureau of Labor and Industries.

      SECTION 5. (1) Notwithstanding any other law, the amount of $355,825 is established for the biennium beginning July 1, 1999, as the maximum limit for the Bureau of Labor and Industries for the payment of administrative expenses from the Wage Security Fund.

      (2) Subsection (1) of this section does not limit, affect or apply to wage claim payments from the Wage Security Fund.

      SECTION 6. Notwithstanding any other law, the amount of $1,271,790 is established for the biennium beginning July 1, 1999, as the maximum limit for the payment of expenses from federal funds collected or received by the Bureau of Labor and Industries.

      SECTION 7. Notwithstanding any other law limiting expenditures of the Department of State Police, for the biennium beginning July 1, 1999, from federal funds collected or received, the limit on expenditures established by section 3 (1), chapter 231, Oregon Laws 1999 (Enrolled House Bill 5043), is increased by $600,000 for purposes of establishing a High Intensity Drug Trafficking Area Intelligence Center and performing enforcement initiatives.

      SECTION 8. In addition to and not in lieu of any other appropriation, there is appropriated to the Department of Education, out of the General Fund, for the biennium beginning July 1, 1999, the amount of $300,000 for development of an education budget model.

      SECTION 9. In addition to and not in lieu of any other appropriation, there is appropriated to the Office of Community College Services, out of the General Fund, for the biennium beginning July 1, 1999, the following amounts for the following purposes:

 

      (1)     Renovations of a facility

               in Troutdale for Mount

               Hood Community College...................... $              100,000

      (2)     For facilities at the

               Woodburn campus of

               Chemeketa Community

               College...................................................... $              200,000

 

      SECTION 10. Notwithstanding any other law, the amount appropriated to the Oregon Youth Authority, out of the General Fund, by section 50, chapter 1053, Oregon Laws 1999 (Enrolled Senate Bill 555), for the biennium beginning July 1, 1999, is reduced by $3,500,000.

      SECTION 11. (1) Notwithstanding any other law, the amount appropriated to the State Commission on Children and Families, out of the General Fund, by section 1, chapter 905, Oregon Laws 1999 (Enrolled Senate Bill 5548), for the biennium beginning July 1, 1999, is reduced by $67,711.

      (2) Notwithstanding any other law limiting expenditures of the State Commission on Children and Families, the maximum limit for payment of expenses from federal funds collected or received by the State Commission on Children and Families, established by section 3, chapter 905, Oregon Laws 1999 (Enrolled Senate Bill 5548), for the biennium beginning July 1, 1999, is reduced by $1,013,069.

      SECTION 12. (1) In addition to and not in lieu of any other appropriation, there is appropriated to the Oregon Criminal Justice Commission, out of the General Fund, for the biennium beginning July 1, 1999, the amount of $14,067,711, which may be expended only for carrying out the purposes of chapter 1053, Oregon Laws 1999 (Enrolled Senate Bill 555).

      (2) In addition to and not in lieu of any other law limiting expenditures of federal funds, the maximum limit for payment of expenses from federal funds collected or received by the Oregon Criminal Justice Commission is increased by $3,638,790 for carrying out the purposes of chapter 1053, Oregon Laws 1999 (Enrolled Senate Bill 555).

      SECTION 13. In addition to and not in lieu of any other appropriation, there is appropriated to the Department of Transportation, out of the General Fund, for the biennium beginning July 1, 1999, the amount of $4,000,000 for elderly and disabled transportation.

      SECTION 14. In addition to and not in lieu of any other appropriation, there is appropriated to the Oregon Watershed Enhancement Board, out of the General Fund, for the biennium beginning July 1, 1999, the amount of $3,700,000 for assessment and monitoring.

      SECTION 15. In addition to and not in lieu of any other appropriation, there is appropriated to the Department of Fish and Wildlife, out of the General Fund, for the biennium beginning July 1, 1999, the following amounts for the following programs:

 

      (1)     Fish Division............................................ $           1,067,347

      (2)     Wildlife Division...................................... $              711,453

      (3)     Administration........................................ $              321,200

 

      SECTION 16. In addition to and not in lieu of any other appropriation, there is appropriated to the Department of Environmental Quality, out of the General Fund, for the biennium beginning July 1, 1999, the amount of $2,800,000.

      SECTION 17. In addition to and not in lieu of any other appropriation, there is appropriated to the Department of Administrative Services, out of the General Fund, for the biennium beginning July 1, 1999, the amount of $350,000 for the Irvington Covenant Community Development Corporation for support of the corporation's program to train and place recipients of public assistance, at-risk youth and first-time youth and adult offenders in modular home construction.

      SECTION 18. There is appropriated to the Legislative Administration Committee, for the biennium beginning July 1, 1999, out of the General Fund, the following amounts for the expenses of the Legislative Administration Committee, which may be expended for the following purposes:

 

      (1)     General Program.................................... $         19,636,376

      (2)     Committees and Task Forces................. $                80,663

 

      SECTION 19. Notwithstanding any other law, the amount of $1,771,276 is established for the biennium beginning July 1, 1999, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Legislative Administration Committee.

      SECTION 20. Section 19 of this 1999 Act does not limit, affect or apply to expenditures for the Stores Revolving Account or supplies for resale.

      SECTION 21. There is appropriated to the Legislative Assembly, for the biennium beginning July 1, 1999, out of the General Fund, the amount of $14,065,569 for payment of the expenses of the Seventieth Legislative Assembly of the State of Oregon.

      SECTION 22. (1) There is appropriated to the Legislative Assembly, for the biennium beginning July 1, 1999, out of the General Fund, the amount of $9,755,315 for payment of the expenses of the Seventy-first Legislative Assembly of the State of Oregon.

      (2) In addition to and not in lieu of any other appropriation, including the appropriation made by section 21 of this 1999 Act, any difference between the amount appropriated by section 5 (1), chapter 688, Oregon Laws 1997, and the amount actually expended within the appropriation on or before June 30, 1999, shall be considered as an appropriation for payment of the expenses of the Seventieth Legislative Assembly.

      SECTION 23. Notwithstanding any other law, the amount of $187,972 is established for the biennium beginning July 1, 1999, as the maximum limit for the payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Legislative Assembly of the State of Oregon.

      SECTION 24. Section 23 of this 1999 Act does not limit, affect or apply to expenditures from the Lounge Revolving Account.

      SECTION 25. There is appropriated to the Legislative Counsel Committee, for the biennium beginning July 1, 1999, out of the General Fund, the amount of $5,413,455.

      SECTION 26. Notwithstanding any other law, the amount of $353,229 is established for the biennium beginning July 1, 1999, as the maximum limit to be paid from the ORS Revolving Account for the payment of legal costs connected with the editing of Oregon Revised Statutes.

      SECTION 27. Notwithstanding any other law, the amount of $1 is established for the biennium beginning July 1, 1999, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Legislative Counsel Committee from state agencies or other offices for bill drafting and any other legal services authorized or required by law to be rendered by the Legislative Counsel Committee, including duties under ORS 183.710 to 183.725, provided pursuant to policies established by the Legislative Counsel Committee.

      SECTION 28. Section 26 of this 1999 Act does not limit, affect or apply to expenditures for legislative publications and printing and distribution of Oregon Revised Statutes.

      SECTION 29. There is appropriated to the Legislative Fiscal Officer, for the biennium beginning July 1, 1999, out of the General Fund, the amount of $3,311,588.

      SECTION 30. There is appropriated to the Legislative Revenue Officer, for the biennium beginning July 1, 1999, out of the General Fund, the amount of $1,160,859.

      SECTION 31. There is appropriated to the Commission on Indian Services, for the biennium beginning July 1, 1999, out of the General Fund, the amount of $311,712.

      SECTION 32. Notwithstanding any other law, the amount of $5,645 is established for the biennium beginning July 1, 1999, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Commission on Indian Services.

      SECTION 33. Notwithstanding any other law, sections 1 to 17 of this 1999 Act are subject to Oregon Department of Administrative Services rules related to allotting, controlling, and encumbering funds.

      SECTION 34. Section 1, chapter 914, Oregon Laws 1999 (Enrolled House Bill 5018), is amended to read:

      Sec. 1. In addition to and not in lieu of any other appropriation, there is appropriated to the Department of Education, out of the General Fund, for the fiscal year beginning July 1, 1999, the sum of [$2,095,878,273] $2,089,978,273 for the State School Fund.

      SECTION 35. If House Bill 3575 becomes law, section 1, chapter 914, Oregon Laws 1999 (Enrolled House Bill 5018), as amended by section 34 of this 1999 Act, is amended to read:

      Sec. 1. In addition to and not in lieu of any other appropriation, there is appropriated to the Department of Education, out of the General Fund, for the fiscal year beginning July 1, 1999, the sum of [$2,089,978,273] $2,093,278,273 for the State School Fund.

      SECTION 36. Section 2, chapter 914, Oregon Laws 1999 (Enrolled House Bill 5018), is amended to read:

      Sec. 2. In addition to and not in lieu of any other appropriation, there is appropriated to the Department of Education, out of the General Fund, for the fiscal year beginning July 1, 2000, the sum of [$2,176,659,018] $2,155,559,018 for the State School Fund.

      SECTION 37. If House Bill 3575 becomes law, section 2, chapter 914, Oregon Laws 1999 (Enrolled House Bill 5018), as amended by section 36 of this 1999 Act, is amended to read:

      Sec. 2. In addition to and not in lieu of any other appropriation, there is appropriated to the Department of Education, out of the General Fund, for the fiscal year beginning July 1, 2000, the sum of [$2,155,559,018] $2,152,259,018 for the State School Fund.

      SECTION 38. Section 5, chapter 914, Oregon Laws 1999 (Enrolled House Bill 5018), is amended to read:

      Sec. 5. In addition to and notwithstanding any other law, the amount of [$100,000,000] $112,000,000 is established for the biennium beginning July 1, 1999, as the maximum limit for payment of expenses from the proceeds of state education lottery bonds for state education projects.

      SECTION 39. Section 6, chapter 914, Oregon Laws 1999 (Enrolled House Bill 5018), is amended to read:

      Sec. 6. (1) Notwithstanding ORS 327.008, the Department of Education shall ensure that the total amount distributed from the State School Fund in grants, transfers and distributions when combined with the total amount of local revenues, as jointly determined by the Legislative Revenue Officer and the Department of Education, for the fiscal year beginning July 1, 1999, does not exceed:

 

      (a)     For school districts

               and the Youth Corrections

               Education Program.................................. [$   3,061,800,000]

                                                                                  $    3,060,900,000

      (b)     For education service

               districts..................................................... $       150,000,000

 

      (2) The distribution limitation established in subsection (1)(b) of this section does not include local revenues transferred from the education service districts in Grant and Wallowa Counties to school districts pursuant to ORS 327.081.

      (3) The distribution limitation established in subsection (1)(b) of this section includes amounts distributed from the State School Fund for the Oregon Public Education Network.

      (4) The distribution limitation established in subsection (1) of this section shall be adjusted for any transfer of expenditures between the 1999-2000 and 2000-2001 fiscal years.

      SECTION 40. Section 7, chapter 914, Oregon Laws 1999 (Enrolled House Bill 5018), is amended to read:

      Sec. 7. (1) Notwithstanding ORS 327.008, the Department of Education shall ensure that the total amount distributed from the State School Fund in grants, transfers and distributions when combined with the total amount of local revenues, as jointly determined by the Legislative Revenue Officer and the Department of Education, for the fiscal year beginning July 1, 2000, does not exceed:

 

      (a)     For school districts

               and the Youth Corrections

               Education Program............................... [$   3,201,000,000]

                                                                                  $    3,184,900,000

      (b)     For education service

               districts..................................................... $       151,100,000

 

      (2) The distribution limitation established in subsection (1)(b) of this section does not include local revenues transferred from the education service districts in Grant and Wallowa Counties to school districts pursuant to ORS 327.081.

      (3) The distribution limitation established in subsection (1)(b) of this section includes amounts distributed from the State School Fund for the Oregon Public Education Network.

      (4) The distribution limitation established in subsection (1) of this section shall be adjusted for any transfer of expenditures between the 1999-2000 and 2000-2001 fiscal years.

      SECTION 41. If Senate Bill 1284 becomes law prior to January 1, 2001, section 7, chapter 914, Oregon Laws 1999 (Enrolled House Bill 5018), as amended by section 40 of this 1999 Act, is amended to read:

      Sec. 7. (1) Notwithstanding ORS 327.008, the Department of Education shall ensure that the total amount distributed from the State School Fund in grants, transfers and distributions when combined with the total amount of local revenues, as jointly determined by the Legislative Revenue Officer and the Department of Education, for the fiscal year beginning July 1, 2000, does not exceed:

 

      (a)     For school districts

               and the Youth Corrections

               Education Program.................................. [$   3,184,900,000]

                                                                                  $    3,199,900,000

      (b)     For education service

               districts..................................................... $       151,100,000

 

      (2) The distribution limitation established in subsection (1)(b) of this section does not include local revenues transferred from the education service districts in Grant and Wallowa Counties to school districts pursuant to ORS 327.081.

      (3) The distribution limitation established in subsection (1)(b) of this section includes amounts distributed from the State School Fund for the Oregon Public Education Network.

      (4) The distribution limitation established in subsection (1) of this section shall be adjusted for any transfer of expenditures between the 1999-2000 and 2000-2001 fiscal years.

      SECTION 42. If House Bill 5016 becomes law, section 6, chapter 887, Oregon Laws 1999 (Enrolled House Bill 5016), is amended to read:

      Sec. 6. (1) Notwithstanding any other law limiting expenditures of the Department of Education, the amount of $2,644,490 is established for the biennium beginning July 1, 1999, as the maximum limit for payment of expenses by the Department of Education from the Lottery Bond Administrative Fund for [issuance] bond-related costs, as defined in section 1, chapter 44, Oregon Laws 1999 (Enrolled Senate Bill 200), of state education lottery bonds issued during the 1999-2001 biennium.

      (2) In addition to and notwithstanding any other law, the amount of $10,872,000 is established for the biennium beginning July 1, 1999, as the maximum limit for payment of expenses by the Department of Education from the Lottery Bond Fund for debt service on the outstanding state education lottery bonds issued during the 1999-2001 biennium.

      SECTION 43. If House Bill 2567 becomes law, section 6, chapter 887, Oregon Laws 1999 (Enrolled House Bill 5016), as amended by section 42 of this 1999 Act, is amended to read:

      Sec. 6. (1) Notwithstanding any other law limiting expenditures of the Department of Education, the amount of [$2,644,490] $3,264,210 is established for the biennium beginning July 1, 1999, as the maximum limit for payment of expenses by the Department of Education from the Lottery Bond Administrative Fund for bond-related costs, as defined in section 1, chapter 44, Oregon Laws 1999 (Enrolled Senate Bill 200), of state education lottery bonds issued during the 1999-2001 biennium.

      (2) In addition to and notwithstanding any other law, the amount of $10,872,000 is established for the biennium beginning July 1, 1999, as the maximum limit for payment of expenses by the Department of Education from the Lottery Bond Fund for debt service on the outstanding state education lottery bonds issued during the 1999-2001 biennium.

      SECTION 44. If House Bill 3575 becomes law, in addition to and notwithstanding any other law, the amount of $20,675,207 is established for the fiscal year beginning July 1, 2000, as the maximum limit of expenses by the Department of Education from moneys received from the Western Oregon Timber Tax Account, the Western Oregon Timber Tax Reserve Account and the Eastern Oregon Timber Tax Account for the State School Fund.

      SECTION 45. If House Bill 3575 becomes law, in addition to and notwithstanding any other law, the amount of $1,637,066 is established for the biennium beginning July 1, 1999, as the maximum limit of expenses by the Office of Community College Services from moneys received from the Western Oregon Timber Tax Account, the Western Oregon Timber Tax Reserve Account and the Eastern Oregon Timber Tax Account for the Community College Support Fund.

      SECTION 46. If House Bill 5038 becomes law, section 13, chapter 908, Oregon Laws 1999 (Enrolled House Bill 5038), is repealed.

      SECTION 47. This 1999 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 1999 Act takes effect July 1, 1999.
