AN ACT
SB 5506
Relating to the financial
administration of the Department of Corrections; appropriating money; limiting
expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. There is appropriated to the Department of
Corrections, for the biennium beginning July 1, 1999, out of the General Fund,
the following amounts for the following purposes:
(1) Institutions, Correctional Programs,
and Inmate Work
Programs.................. $ 430,445,302
(2) Community Corrections......................... $ 173,479,461
(3) Central Support/Operations
and Administration................................. $ 71,155,890
(4) Capital Improvements............................ $ 1,297,826
(5) Debt Service............................................. $ 80,209,053
SECTION 2. Notwithstanding any other law, the
following amounts are established for the biennium beginning July 1, 1999, as
the maximum limits for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, including Anti-Drug Abuse Act funds, but
excluding lottery funds and federal funds, collected or received by the
Department of Corrections, for the following purposes:
(1) Institutions, Correctional
Programs, and
Inmate
Work Programs...................................... $ 47,704,608
(2) Central Support/Operations
and Administration................................. $ 15,584,146
(3) Capital Improvement.............................. $ 1,370,875
SECTION 3. Notwithstanding any other law, the amount
of $8,041,851 is established for the biennium beginning July 1, 1999, as the
maximum limit for payment of expenses from federal funds collected or received
by the Department of Corrections for Institutions.
SECTION 4. Section 2 (1) of this 1999 Act does not
limit, affect or apply to expenditures for the purchase of raw materials for
Inmate Work Programs.
SECTION 5. Notwithstanding any other law, all sections
of this 1999 Act are subject to Oregon Department of Administrative Services
rules related to allotting, controlling, and encumbering funds.
SECTION 6. In addition to and not in lieu of any other
appropriation, there is appropriated to the Emergency Board, out of the General
Fund, for the biennium beginning July 1, 1999, the sum of $1,190,230 for
allocation only to the Department of Corrections, after the April 2000 prison
population forecast, for population management and rebalance issues. Any moneys
that remain unallocated and unobligated by the Emergency Board on November 1,
2000, become available for any purpose for which the Emergency Board may
lawfully allocate funds.
SECTION 7. This 1999 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 1999 Act takes effect July 1, 1999.
