AN ACT

 

HB 5004

 

Relating to the financial administration of the State Department of Agriculture; appropriating money; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

      SECTION 1. (1) There is appropriated to the State Department of Agriculture, for the biennium beginning July 1, 1999, out of the General Fund, the following amounts for the following purposes:

 

      (a)     Agency operations................................... $         22,754,009

      (b)    Debt service............................................. $              279,713

 

      (2) Within the appropriation made by subsection (1)(a) of this section, payment is authorized for expenses of the State Department of Agriculture in connection with entertainment for furthering economic development.

      SECTION 2. Notwithstanding any other law, the following amounts are established for the biennium beginning July 1, 1999, as the maximum limits for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but including receipts for federal contract services, but excluding lottery funds, collected or received by the State Department of Agriculture, for the following purposes:

 

      (1)     Agency operations................................... $         37,208,475

      (2)     Debt service............................................. $                54,230

 

      SECTION 2a. (1) In addition to and not in lieu of any other appropriation, there is appropriated to the Emergency Board, for the biennium beginning July 1, 1999, out of the General Fund, the sum of $500,000 for allocation only to the State Department of Agriculture for agency operations related to Oregon Plan activities.

      (2) If all of the moneys referred to in subsection (1) of this section are not allocated by the Emergency Board prior to November 1, 2000, the remaining moneys on that date become available for any other purpose for which the Emergency Board lawfully may allocate funds.

      SECTION 3. Notwithstanding any other law, the amount of $3.9 million is established for the biennium beginning July 1, 1999, as the maximum limit for the payment of expenses from lottery moneys allocated from the parks and natural resources fund to the State Department of Agriculture for activities and projects to implement section 4 (5), Article XV of the Oregon Constitution.

      SECTION 4. Notwithstanding any other law, the amount of $5,062,931 is established for the biennium beginning July 1, 1999, as the maximum limit for payment of expenses from federal funds received by the State Department of Agriculture.

      SECTION 5. Notwithstanding any other law, all sections of this 1999 Act are subject to Oregon Department of Administrative Services rules related to allotting, controlling, and encumbering funds.

      SECTION 6. This 1999 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 1999 Act takes effect July 1, 1999.
