AN ACT
HB 5063
Relating to state financial
administration; appropriating money; limiting expenditures; and declaring an
emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. There is appropriated to the Department of
Human Resources, for the biennium beginning July 1, 1999, out of the General
Fund, the amount of $2,210,824,347, to be expended for:
(1) Economic Independence and

SECTION 2. Notwithstanding any other law, the amount
of $755,125,105 is established for the biennium beginning July 1, 1999, as the
maximum limit for the payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, tobacco tax receipts and Medicare receipts
and federal funds for indirect cost recovery, but excluding lottery funds,
collected or received by the Department of Human Resources for:
SECTION 6. Sections 2 and 3 of this 1999 Act do not
limit, affect or apply to expenditures for Women, Infant and Children Nutrition
Program food vouchers, federal Food Stamp benefit payments and Community Health
Insurance Program reimbursable drug purchases.
SECTION 7. This 1999 Act does not prohibit the
Department of Human Resources from transferring funds and expenditure
limitations between divisions and programs identified in a single subsection of
section 1, 2, 3, 4 or 5 of this 1999 Act or, for the Mental Health and
Developmental Disability Services Division, between divisions and programs
identified in section 1 (2) and (3), 2 (2) and (3), 3 (2) and (3) or 5 (3) of
this 1999 Act.
SECTION 8. Notwithstanding ORS 411.010 and 413.029,
the funds appropriated by this 1999 Act shall not be used to meet the costs of
burials, except for persons in the care and custody of the Department of Human
Resources.
SECTION 9. (1) That portion of the payment received
during the 1997-1999 biennium by the Department of Human Resources from health
districts in this state under the Proportionate Share Incentive Adjustment
State Plan Amendment to the State Medicaid Plan and under intergovernmental
agreements with the health districts that is attributable to the federal funds
portion of the total payment made by the department to the health districts
during the 1997-1999 biennium shall be transferred to the General Fund.
(2) That portion of the
payment received during the biennium beginning July 1, 1999, by the Department
of Human Resources from health districts in this state under the Proportionate
Share Incentive Adjustment State Plan Amendment to the State Medicaid Plan and
under intergovernmental agreements with the health districts that is
attributable to the federal funds portion of the total payment made by the
department to the health districts during the biennium beginning July 1, 1999,
shall be transferred to the General Fund.
SECTION 10. Notwithstanding any other law, all sections
of this 1999 Act are subject to Oregon Department of Administrative Services
rules related to allotting, controlling and encumbering funds.
SECTION 11. This 1999 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 1999 Act takes effect on its passage.
