AN ACT

 

SB 919

 

Relating to community-based services for persons with developmental disabilities.

 

Be It Enacted by the People of the State of Oregon:

 

      SECTION 1. (1) The Mental Health and Developmental Disability Services Division shall develop a plan that includes the following:

      (a) A statement of eligibility for developmental disability services;

      (b) A description of how services can be uniformly accessed statewide by all eligible individuals and their families;

      (c) A description of minimum supports and services available to all eligible individuals and their families;

      (d) A proposed methodology for adjusting support and service levels on the basis of the needs of the eligible individual combined with family or other circumstances affecting the individual's care; and

      (e) A proposed methodology for determining the circumstances when out-of-home, 24-hour care may be necessary.

      (2) The plan shall include an analysis of the budgetary and programmatic effects of providing supports and services for all eligible individuals and their families, including any necessary changes to Oregon laws and rules.

      (3) In developing the plan, the division shall work with affected parties, including but not limited to consumers, families, providers, advocates, contractors, county developmental disability programs and other partners.

      (4) The division shall present the plan to the appropriate interim committee of the Legislative Assembly no later than February 1, 2000.
