AN ACT

Relating to stream management; and limiting expenditures.

 

Be It Enacted by the People of the State of Oregon:

 

      SECTION 1. (1) The Division of State Lands may contract with the Oregon Water Resources Research Institute at Oregon State University to conduct an analysis of the Willamette River from river mile 50 to river mile 165 of the effects of dredging and other methods of achieving the multiple beneficial objectives of riverbank erosion control, flood control, fisheries conservation, commerce, tourism and recreational boating access. The analysis may include a review of existing data and, by the most cost-effective means available, the collection of new data necessary to accurately assess the costs, benefits and impacts of dredging and other methods of achieving the multiple beneficial objectives identified in this subsection.

      (2) The analysis under subsection (1) of this section may include but need not be limited to the following studies:

      (a) A hydrologic study, which shall address at a minimum:

      (A) River levels;

      (B) Flood flows; and

      (C) The effect on fish and other aquatic fauna.

      (b) A hydraulic study, which shall address at a minimum:

      (A) Velocity and depth of water;

      (B) Flow direction;

      (C) Water interactions with the bed and banks of the river;

      (D) Bank erosion;

      (E) Impacts on channel shape;

      (F) Sediment movement; and

      (G) Navigation.

      (3) The Division of State Lands shall report the results of any analysis to the Seventy-first Legislative Assembly.

      SECTION 2. Notwithstanding any other law, the amount of $1 is established for the biennium beginning July 1, 1999, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, excluding lottery funds and federal funds, collected or received by the Division of State Lands for the purpose of contracting the analysis under section 1 of this 1999 Act.
